APPLICATION FOR CONDONATION OF DELAY

The applicant named above begs to submit as under:-

1. That, the appellant filed this Appeal against his conviction U/s 20(b)
ii-c of NDPS, in this Criminal Appeal but 14 days of delay in filing the
Appeal.
2. That, the impugned judgment is delivered on 23.06.2023 and the
instant appeal is filed on 05.09.2023.
3. That, soon after delivery of judgment the appellant was taken into
custody and sent to jail. The appellant failed to informed any of his
family members about his right of appeal and consequently delay of
14 days has occurred in filing this instant Appeal.
4. That, the delay is bona-fide because the appellant is in jail and he
depends on his out side relatives for filing and prosecuting this
appeal.
An affidavit in support of this application is filed herewith.
PRAYER
It is, therefore humbly prayed before the Hon'ble Court may kindly
be pleased to condone the delay of 14 days committed in filing this
appeal, in the interest of justice.

Yadav Mohalla, Gwarighat Road, Jabalpur (M.P.), do hereby solemnly
affirm on oath as under:-

1. That, I am relative of appellant in the instant criminal appeal and


well conversant with the facts of case.

2. That, the instant application for condonation of delay has been


drafted by my counsel as per my instruction. The contents of
application from paras 1 to 4 have been read over and understood
by me in Hindi, which are true and correct to my personal
knowledge and belief.
