ORDER : The Court Made the following order :-

The petitioners, who apprehend arrest at the hands of the respondent police for

the offence punishable under Sections 406, 420, 120(B), 294(b) and 506(ii) of IPC in

Crime No.15 of 2024, on the file of the respondent police, seek anticipatory bail.

2.The case of the prosecution is that the petitioners and the defacto complainant

and his wife formed a partnership to run a diesel pump workshop namely, Bharath

Pump House in 2008. Later, in the year 2010, the defacto complainant entered into a

partnership agreement with the first petitioner herein to establish a BPCL Gas

Agency at Theni. After establishing the said BPCL gas outlet, the petitioners herein

refused to pay the profits share arose out of the gas outlet. Hence, the case.

3.The learned counsel for the petitioners submits that the defacto complainant

and his wife had retired from the partnership firm in the year 2011 itself and he has

also enclosed the deed of dissolution of partnership.

4.The learned Senior Counsel for the defacto complainant submits that there are

enough materials to show that the defacto complainant's firm is running as a joint

partnership firm and there are several transactions in between the petitioners and the

defacto complainant.

5.During the course of arguments, it is suggested that the issue among the

petitioners and the defacto complainant can be solved amicably and the learned

counsel sought for referring the mater to the Mediation and Conciliation Centre. On

the suggestions made by the petitioners and the defacto complainant, this Court

refers the matter to the Mediation and Conciliation Centre attached to this Bench.

6.This Court appoints Mr.R.Karunanidhi, learned counsel, [Enrl. No: 2919 of

2008 and Cell No.9994513250] as Mediator in this case. The parties shall find out the

convenience of Mr.R.Karunanidhi, Mediator and schedule the mediation accordingly.

7.Mr.R.Karunanidhi, learned counsel, who is appointed as Mediator, shall

mediate the parties and file a report before this Court on or before 28.06.2024.

8.Post the matter on 28.06.2024.

9.Till such time, the petitioners shall not be harrassed.
