WHAT IS MLC?
The Maritime Labour Convention (MLC), also known as the "Seafarers' Bill of
Rights," is an international labor convention adopted by the International
Labour Organization (ILO). It establishes minimum working and living
standards for seafarers, covering a wide range of issues such as employment
conditions, accommodation, recreational facilities, health protection, medical
care, and social security.
The MLC aims to ensure that seafarers have decent working and living
conditions regardless of their nationality or the flag of the vessel they work on
MLC 2006 includes all previous and individual ILO (international labour
organization) conventions under one common umbrella.

STRUCTURE OF MLC
MLC 2006 comprise of two components: Part A "Standards" and the part B
"Guidelines".
The articles, regulations and the Code part "A" are mandatory, and the Code
part "B" is recommendatory.
Its regulations and Codes are focused in five main areas, which are: minimum
requirements for seafarers to work on a ship; conditions of employment;
accommodation, recreational facilities, food and catering; health protection,
medical care, welfare and social security protection; and, compliance and
enforcement.
SEAFARERS' EMPLOYMENT
AND SOCIAL RIGHTS
As a bare minimum every seafarer has the right to:
1) Safe and secure workplace that complies with safety standards
2) Fair terms of employment
3) Decent working and living conditions
4) Health protection, medical care, welfare measures and other
forms of social protection
5) Compliance and enforcement
1. SAFE AND SECURE
WORKPLACE ON A SHIP
a. Employment of persons under the age of 16 shall be prohibited
b. Shall not work on a ship unless they are certified as medically fit to
perform their duties;
c. Or they are not trained or certified as competent or otherwise qualified
to perform their duties; and unless they have successfully completed
training for personal safety on board ship
d. Seafarers shall have access to an efficient, adequate and accountable
system for finding employment on board ship without charge to the
seafarer
2. FAIR TERMS OF EMPLOYMENT
a) Employment agreement guaranteeing decent on-board working and living
conditions to be signed by both the seafarer and the ship owner or
representative of the shipowners
b) Monthly pay in full; ensuring seafarers are able to transmit their earnings to
their families
c) Minimum wage to be calculated by prescribed formula taking into account
cost of living, exchange rates and updated at periodical meetings attended by
ISF, ITF and ILO Commission
d) Rest hours
e) Paid Annual Leave
f) Shore leave
g) Repatriation and compensation in case of illness, loss of employment arising
from ship's loss or foundering
3. DECENT WORKING AND LIVING
CONDITIONS ON SHIP
a) Minimum room sizes, satisfactory heating, ventilation, sanitation facilities,
lighting and hospital accommodation; consistent with promoting the
seafarer's health and well-being
b) Access to good quality food and drinking water provided under regulated
hygienic conditions, with appropriate quality, nutritional value and quantity
that adequately covers the requirements of the ship and takes into account the
differing cultural and religious backgrounds
c) To ensure that seafarers who are engaged as ships' cooks are trained,
qualified and found competent for the position.
4. RIGHTS TO HEALTH PROTECTION,
MEDICAL CARE AND OTHER SOCIAL
PROTECTION
a) Quick medical care on board or ashore
b) Help from owner for sickness or injury costs
c) Safety training and accident prevention
d) Family access to social security benefits
5. COMPLIANCE AND ENFORCEMENT
a) For ships over 500 GT on international voyages (including local
voyages in another country by a ship flagged by a member), a
"Maritime Labour Certificate" and a "Declaration of Maritime
Labour Compliance" will be required. Must be issued by the Flag State
and must be available on board for PSC Inspection.
b) Once in force, Port States and Flag States will have the right to board
ships for inspections to verify compliance with the Convention.
DMLC (DECLARATION OF MARITIME
LABOUR COMPLIANCE)
The Declaration of Maritime Labour Compliance (DMLC) is a document that
establishes the labor standards and working conditions for seafarers on board
ships. The DMLC consists of two parts.
Part I: This section explains the rules and laws in a country that follow
international rules to protect the rights and working conditions of sailors
Part II: This section includes a statement from the owner or operator of a ship
confirming that they follow the rules described in Part I. It's a promise from the
ship owner to obey labor standards and ensure sailors have good working and
living conditions on their ships.
