CONSUMER RIGHTS

INTRODUCTION
In this chapter we shall read :

i) Who are consumers and the factors exploiting


consumers
ii) Consumer movements
iii) Steps taken by the government to protect the
interests of consumers
iv) Rights of consumers
v) Problems with consumer movement
CONSUMER
• Consumer is a person who purchases and uses goods and
services from the market after making the payment
• Consumers participate in marketplace by purchasing final
goods and services they need
• Consumers are exploited in the market because they do
not insist on their rights
• Rules and regulations are required for the protection of
the consumers in the marketplace
FACTORS EXPLOITING
CONSUMERS
Factors exploiting customers are as follows :
i) Companies giving false or incomplete information
ii) Selling adulterated and impure food items
iii) Charging more price than listed
iv) Selling substandard products
v) Indulging in unfair trade practices
CONSUMER MOVEMENT
• The consumer movement arose out of dissatisfaction of the consumers as
many unfair practices were being indulged in by the sellers
• In India, the consumer movement as a ‘social force’ originated with the
necessity of protecting and promoting the interests of consumers against
unethical and unfair trade practices.
• Rampant food shortages, hoarding, black marketing, adulteration of food
and edible oil gave birth to the consumer movement in an organized form in
the 1960s
• Till the 1970s, consumer organisations were largely engaged in writing
articles and holding exhibitions only
• More recently, India witnessed an upsurge in the number of consumer
groups
STEPS TAKEN BY THE GOVERNMENT TO PROTECT CONSUMERS

• A major step taken in 1986 by the Indian government was the enactment
of the Consumer Protection Act 1986, popularly known as COPRA
• Under COPRA, a three-tier quasi-judicial machinery at the district, state
and national levels was set up for redressal of consumer disputes
• The district-level authority called District Consumer Disputes Redressal
Commission deals with the cases involving claims up to Rs 1 crore.
• The state-level Consumer Disputes Redressal Commissions called State
Commission between Rs 1 crore and Rs 10 crore
• The national-level commission — National Commission — deals with cases
involving claims exceeding Rs 10 crore
RIGHTS OF CONSUMERS

Consumer rights include :


i) Right to be protected
ii) Right to be informed
iii) Right to choose
iv) Right to seek redressal
v) Right to represent
RIGHT TO BE PROTECTED :
Consumers, have the right to be protected against the marketing of goods and
delivery of services that are hazardous to life and property
Producers need to strictly follow the required safety rules and regulations.
There are many goods and services that we purchase that require special attention to
safety. The manufacturers of the safety device have to ensure high quality
RIGHT TO BE INFORMED :
Consumers have the right to be informed about the particulars of goods and s
services that they purchase.
Consumers can then complain and ask for compensation or replacement if the
product proves to be defective in any manner.
Manufacturers have to display certain information because consumers have
the right to be informed about the particulars of goods and services that they
purchased
RIGHT TO CHOOSE :

Any consumer who receives a service in whatever capacity, regardless


of age, gender and nature of service, has the right to choose whether to continue
to receive the service

RIGHT TO SEEK REDRESSAL :

Consumers have the right to seek redressal against unfair trade practices
and exploitation. If any damage is done to a consumer, she has the right to get
compensation depending on the degree of damage.

RIGHT TO REPRESENT :

Consumers have the right to seek redressal and demand compensation.


While seeking any redressal , the consumers have the right to be represented in
consumer courts.
PROBLEMS WITH CONSUMER
MOVEMENT
 The consumer redressing process id difficult ,expensive and time
consuming
 Existing laws are not very clear on the issue of compensation to
customers.
 Law enforcement in unorganized sector is weak.
 Court proceedings for consumer redressal are long.
 Most of the traders do not issue cash memos
 Rules and regulation for market functioning are not followed.
