WHAT IS MURDER?
• Murder is defined as the unlawful killing of a human being with malice
aforethought. • This means that the act is premeditated or deliberate, differentiating it from other forms of homicide like manslaughter. • Murder is considered one of the most serious crimes and is often subject to the harshest penalties under the law. TYPES OF MURDER First-degree Murder This type of murder is intentional but not premeditated.
Second-degree Murder This type of murder is intentional but
not premeditated.
Felony Murder A killing that occurs during the
commission of a dangerous crime, even if the death is accidental. ELEMENTS OF MURDER Actus Reus The physical act of killing someone
Mens Rea The mental intent to kill or cause
serious harm.
Causation The act must directly lead to death.
Unlawfulness The killing must be against the law.
(excluding self-defense or war) RULES FOR THE APPLICATION OF THE CIRCUMSTANCES WHICH QUALIFY THE CRIME OF MURDER Premeditation The crime was planned in advance, demonstrating clear intent to kill.
Cruelty or Heinousness The murder involved excessive brutality,
torture, or cruelty beyond what is necessary to cause death.
Murder for Hire The killing was committed in exchange for
payment or other benefits.
Vulnerable Victim The victim was particularly vulnerable, such as
child, elderly person, or disabled individual.
Use of Poison The murder involved the use of poison, which
is often considered especially deceitful or malicious.
