WHAT IS RTI ?

 RTI is a law that gives citizens right to request


information from public authorities and private bodies.
It was passed by United Progressive Alliance-1 (UPA)
government led by Dr M. Manmohan Singh.
It was :
 Enacted on: 15 June 2005.
 Assented to: 22 June 2005.
 Commenced on: 12 October 2005.

• You would be given a registration number. If


you don’t get it immediately, you would get
it within 48 hours of your application.
• The department must answer to your
request within 30 days of your request.
WHAT IF MY REQUEST IS NOT ANSWERED?

• It may be that you addressed to wrong department. In this case, your


request would be replied through same officer you addressed. It may,
therefore, take some time. You need not panic in that case. The
extended time in this case is usually 5 days.
• You can appear to appellant authority if your request is not answered
within 45 days.
• You can appeal through the same site if you are not answered. The
time period to answer the appeal is 30 days.
NOT SATISFIED BY INFORMATION?

• You can appeal if you are not satisfied by the information provided to
you. The appeal must be answered within 30 days.
• The senior officers may even put a fine on junior if they feel that they
did not answer you properly or are not putting efforts to answer you.

• CBSE v. Aditya Bandopadhyay & Ors


 Aditya wanted to seek answer sheets his son wrote in Board exams.
 Regarding the request for copies of answer sheets, Mr. Mohan Chandran, Assistant
Secretary stated that they are not public authority and hence there are under no
obligation to share the information.
 The Supreme Court has delivered a landmark judgment in CBSE v Aditya Bandopadhyay
& Ors. [2011 (8) SCC 497] finally settling principle on sharing the answer sheets of the
candidates in the interest of protecting the standards of education through transparency.

process.
• Every public authority is required to provide reasons for its
administrative or quasi-judicial decisions to the affected
persons.
• Promotion of partnership between citizens and the Government
in decision making process.
• The RTI Act provides a framework for promotion of citizen
government partnership in carrying out the programmes for
welfare of the people.
REDUCTION IN CORRUPTION IN

• In absence of transparency and accountability encourage the
government officials to corruption practices, creating an
environment of distrust between people and government,
which hinders the development of democratic governance.

CONSTRAINT IN THE WORKING OF RTI

• Lack of public awareness


Many people in India are unaware of their rights and duties, especially in
rural areas. The following shows results of survey conducted to examine
the awareness about the rti act:
• Poor quality of information

As per survey available available on the rti.gov.in website around 75% of the citizens are
dissatisfied
with the quality of information being provided. The corresponding figure for OBC/SC/ST
category of citizens
stood much higher with 86% dissatisfied citizens.
Inadequate space and infrastructure
• There may not be enough space, staff, or infrastructure to maintain records and
manage files.
• The current record management guidelines at Centre and in most states are not
geared to meet the requirements specified under the RTI Act
• There is lack of any electronic document management system in any of the
Departments (basis the Information Provider Survey).
• Majority of the PIOs surveyed do not even maintain the list of RTI applications
electronically
Inadequate trained PIOs and First Appellate Authorities:

An in-depth understanding of the RTI Act is a basic requirement of a PIO to discharge duties
effectively. However as per the findings of the survey conducted under this study, only 55% of
surveyed PIOs had received RTI training. During discussions with the PIOs and the ATIs, it was
highlighted that the frequent transfers/ changes in the PIOs adds to the challenge.

CONCLUSION

• The RTI Act, 2005 is a milestone in India’s democratic journey,


helping citizens to exercise their right to know and demanding
accountability from the government. Despite challenges, the RTI law
has had a significant impact in promoting transparency and reducing
corruption in India.
• While challenges remain, continued awareness and enforcement of the
Act are crucial for realizing its full potential in promoting transparency
and accountability.
