INTRODUCTION
• Virtual Courts are a concept, aimed at eliminating the presence of litigants or lawyers
in the court and for adjudication of cases on a virtual platform.
• In 2019, Faridabad became the site of India's first all-digital court. Before that point,
there hadn't been many efforts put into replacing physical courts with online ones.
• The Supreme Court Vidhik Anuvaad Software (SUVAS) on National Constitution
Day, 2019 was introduced by the President of India on November 26, 2019, and it
can convert legal documents from English to nine regional languages.
• After the e-courts initiative is launched, 21 High Courts and 18,000 District Courts in
India may utilize the filing software.
• Many nations, including India, have implemented online dispute resolution (ODR),
which bodes well for virtual courts in India. Popular ODR systems include CODR,
Sama, Presolv360, CADRE, and Creek ODR.
ADVANTAGES
• Cost-effective virtual courts exist. Weekdays are tribunal-free. Limiting court hours
reduces access. Virtual courts allow 24/7/365 videoconferencing hearings. Remote
court attendance means litigants won't miss work.
• A fully computerized court system may decrease technological, human, and security
costs. No one would have to travel to court, saving time and money.
• Digitalizing the judiciary will increase openness and efficiency. Adopting video
conferencing to reduce COVID-19 in the courtroom has evolved to virtual courts
using distant video technologies.
• The court's 24/7 operation is a major plus. Long delays in resolving cases have
damaged public trust in the courts. As a result, matters will be decided quickly.

E-COURT PROJECT
• E-courts' website offers litigants the option to check a case's status, electronic cause
lists, and PDF daily orders.
• The National Judicial Data Grid is the e-courts initiative's most major data collection
achievement (NJDG). The e-filing manual covers how to electronically file court
documents.
• In August 2018, three programs were introduced, including e-Filing, e-Pay, and
NSTEP (National Service and Tracking of Electronic Processes).
• Using e-court filing, litigants can pay court charges online.
• The National Service and Tracking of Electronic Processes helps transmit
documents to other courthouses and the Court Officer's mobile app.
• Enabling GPS allows for an image and signature of the required individual after the
service is done.
• There's also a facility for e-mailing or texting litigants’ case updates.
RISE IN THE ONLINE DISPUTE RESOLUTION IN INDIA
• According to the UN Commission on International Trade Law Working Group, online dispute
resolution is "a way for resolving disputes via electronic methods of communications and other
information and communication technology.“
• ADR includes mediation, negotiation, and arbitration, but is confined to civil issues where both
parties agree to participate.
• 70% of respondents said they would choose mediation to resolve conflicts. Several ODR
solutions have enhanced usability and efficiency.
• CADRE's ODR Manifesto lets one side contact the website first. Video chats are used when
both sides agree on an arbitrator. Both parties receive email or WhatsApp. 25-30 days till the
meeting's legally binding conclusion. This technology helps Nest Away resolve renter-landlord
issues.
• Sama is another well-known ODR platform that supports online dispute resolution. ICICI Bank
uses Sama to settle disputes of up to INR 20 lakhs, or 10,000 disputes.
• Agami is a non-profit ODR platform that combines time stamping and a simple dispute
resolution approach.
