Vibe Productions: Understanding The Creative Media Sector LO2: Understand The Legal and Ethical Constraints

The document discusses several legal and ethical issues relevant to the creative media sector, including copyright law, the British Board of Film Classification, and representations of gender and religion in films. Copyright law protects original creative works and is important for the film industry to prevent others from profiting off others' work without permission. The British Board of Film Classification classifies films to ensure they are suitable for cinema audiences and follow industry guidelines. Representations of gender and religion in films should aim to portray all groups as strong and independent, though some genres and films still rely on stereotypes.

Copy Right Law

- Source - http://saperlaw.com/2007/06/18/film-production-copyright/
- The importance of this in film is to be able to claim and prove any
creative work made is by you. Copyright is a form of legal protection on
many types of creative work in order to be protected the work must be
original which means it is not copied, it must be in a permanent or stable
form such as video/film recording.
- Breaching the copyright law could result in a polite letter asking you to
remove it, a notice demanding you to remove or stop distributing this
work or you can even face penalties such as fines and jail but it depends
on the extent of the infringement. An example of this is the Rogers vs.
Koons, Rogers produced a photograph of two people holding a line of
puppies and sold it on greeting cards etc... Koons then reproduced this
image but in a different style and made a profit off of this. Rogers then
took him to court over this and Koons lost the case because of this
breach of the copyright law.

- This law is relevant to the film industry because a similar thing could
happen to films without it being copyrighted, someone could claim the
material as theirs and make a profit off of this, without it being
copyrighted its not breaking the law so not much may not be done about
it.
What is the films act?
- This was an act in 1927 of the United Kingdom Parliament designed to
stimulate the UKs film industry, this act introduced a rule for UK cinemas
to show a quota of British films for a duration of ten years this means a
limited or fixed number of them shown over this ten year period. The
idea of this was to try and be better than Hollywoods renowned
dominance within the film industry, by promoting similar business in
order to try and increase economic activity within the UK production
sector, originally set out at 7.5% for exhibitors which was then raised to
20% in 1935. The reason this is relevant to the film industry is because
without this act film/cinema in the UK may still be at an economical
decrease or a standstill, this act helped the industry economically by
promoting similar business putting the industry on an increase. There are
many similar acts which benefited and hindered the film industry.
Importance of ethical issues
- Media ethics is the sector of applied ethics dealing with the specific
ethical values and standards of media. These are things like broadcasting
media film & theatre and the internet etc Ethics are the moral
principles that define how a group or person acts, in the media sector
problems faced are things like; privacy, truth and mostly trust.
- Copyright is a big issue in the media industry this is a legal protection on
original material to prevent it being used by someone else however it can
only be applied on the application of the idea not the idea itself.
- Its also illegal to discriminate anyone when recruiting in the workplace,
this means there is equal opportunities.
- Film producers must also be aware of the official secrets act 1911 and the
prevention of terrorism act.

Health and safety is a huge issue and risk assessments must be taken
out before a production in order to ensure everybodys health and safety.
- These issues should be taken into considerations when coming to a
productions.

Representation of Gender
- Depending on the genre of the film the representation between genders
can differ. Romance, Horror and fantasy are a good example where the
man will be a stereotype every girls crush and the hero of the movie,
good looking and a big personality. Twilight is a good example of this
because of the male dominance fighting over a girl which is a typical
storyline.

But the girl in this film is also strong and determined but the relationships
with these two men makes it look as if she is week.

In The Wolf Of Wall Street the man is dominant but as well as the women,
she is represented as a strong independent women, this is the same with
women in most movies apart from genres like horror where the typical
story line is the girls die first or there is always a girl and guy left.

Representation of religious beliefs

-

Religious beliefs within movies are expressed strongly and I believe it

benefits religions hugely, without the exceptions of movies which are
racist towards religions for example The Boy in Striped Pyjamas which is
a recreation of the war and the killing of the Jews.
A good example of this would be Life of Pi, this movie represents a
Muslim man as a very strong and courageous person and puts it across in
the way that Muslims religion is a strong religion.

Men and women should be represented in the way of both the gender
being both strong and independent and most movies do this with obvious
exceptions.

My studio represents people in a very good way by representing them

both as strong and independent how it should be and most are.

British Board of Film Classification

- This non-government board has been classifying cinema films since it
was set up in 1912 and videos since the passing of video recordings
1984. The importance of this is too classify movies/films to see if they are
suitable for cinema, this is the reason for ethics and following
rules/guidelines within the film industry.

Film Distributors Association
- Film distribution describes everything that happens in between
production and exhibition this includes the deals done the film shown and
including the promotion of the movie. This helps the movie to get out in
cinema and determines whether it can or not, they control the
distribution of the products and of others.

British Academy of Film and Television Arts
- An independent charity that develops, supports and promoted the art
forms of moving image, The BAFTA rewards excellence, inspiring
practitioners and benefits the public.
British Interactive Multimedia Association
- BIMA is similar to BAFTA and is an interactive media association that
supports/promotes the British digital industry, rewards great work and
encourages the next generation.
