AFFIDAVIT-COMPLAINT

I, LENI LEILA YAN, Filipino, of legal age and a resident of


Ambiong Road, Aurora Hill, Baguio City, after having been duly sworn in
accordance with law, hereby depose and state that:

This complaint-affidavit is being filed to charge Roddy Davao,


Filipino, of legal age, and with residence at Lower Ferguson Road, Guisad
Central, Baguio City, of the crime of Rape under Article 266-A of the
Revised Penal Code, committed as follows:

1. Days before new year, my friend Kai Bigan invited me to celebrate


new year at their house at Ambiong Road, Aurora Hill, Baguio City,
to which I accepted;

2. She also invited our other friends, and the accused Roddy was one of
them;

3. On new years eve, I went to Kais house at around 7 oclock in the


evening as I promised to help her prepare the food to be served during
the party;

4. At around 10:30 pm, a red car arrived and accused Roddy Davao
alighted therefrom;

5. Upon alighting the car, we greeted each other and proceeded to the
balcony to have some drinks.

6. At around 11 pm, I was feeling a little dizzy hence I asked Kai if I


could sleep for a while in her room, to which she agreed;

7. Upon reaching the bedroom, I closed the door and I decided to lie
down for a while in time for the midnight celebration.

8. As I was about to get my sleep, someone knocked at the door and


surprisingly it was Roddy;

9. I was surprised, but because Roddy had been my trusted long time
friend, I relaxed and started to slumber;

10. He asked me if I was feeling okay, to which I replied I just needed to


sleep for a while to rest;

11. He said he was concerned about me so he followed me to the room to


check on me, gave me medicine and a glass of water, and thereafter
bid goodbye;

12. On the thought that Roddy went out of the room, I laid down on my
right side,

13. A few minutes around 15 minutes or so, I suddenly felt someones


hands were caressing my thighs and kissing my neck;

14. When I opened my eyes, I saw that it was Roddy who was there in
the room and I asked him Ginagawa mo? (What are you doing?)

15. He whispered Alam ko naman gusto mo rin ito. (I know you want
this too.) and he continued kissing my neck and caressing my thighs.

16. I began to struggle and then I realized that my hands were already
tied behind my back to which I tried to scream for help.

17.When I screamed for help, he covered my mouth his left hand and
took out a handkerchief and gagged me with it.

18. He then tried to undress me but I still tried to wrestle my way out and
attempting to resist every advances he made but he was too strong for
me;

19. I knew it was already midnight because I can hear the sound of
fireworks exploding;

20. He then forcibly pulled down my underwear;

21. As he was taking his pants off, I continued move attempting to


remove the scarf and preventing his advances towards me and as I
struggled, the bed moved which hit the bedside table knocking off a
glass of water on top of it which broke;

22. Afterwards, Kai Bigan and our other friends Renz Alvarez and
Rocky Bato hurriedly went to the room and saw usme gagged and
tied, and Roddy with his pants down;

23. Rocky shouted: Tang ina pre! Ano ginagawa mo?! (WTF! What are
you doing?!) while rushing towards us.

24. An altercation ensued between Roddy and Rocky and Renz and they
were able to restrain Roddy.

25. Kai approached me afterwards and untied my hands and removed the
handkerchief in my mouth.

26.She saw my underwear was ripped and my dress all torn from the
struggle and she gave me blanket to cover myself with.

27. Rocky called the police and Renz was holding Roddy;

28. A few minutes later, three police officers came and asked what
happened.

I executed this affidavit to attest to the truthfulness of the foregoing


facts and to support the filing of a criminal case for Attempted Rape against
Roddy Davao.

IN WITNESS WHEREOF, I hereunto affixed my signature this 20 th


day of January, 2017 at Baguio City, Philippines.
