CRIMINALIZATION OF PHYSICAL PUNISHMENT FOR CHILDREN

‘The parental right to use physical force to discipline and restrain children is a privilege

firmly rooted in the Country’s system of jurisprudence. This privilege is often asserted as a defense

when parents are charged with a crime of aggression against their child. While the privilege to

use disciplinary force is universally recognized as a defense in criminal actions, it is equally

acknowledged that child abuse is a pervasive reality of life’, (Jhonson, 2009). However, the

process of teaching children right from wrong, parents must not grossly degrade, inflict physical

injury upon, or subject to serious emotional harm the children entrusted to their care but they

must do their best to bold their children’s personality and discipline in some light punishments

so that the child can simply realize the committed mistake and rest assured that the child will

never be abused.

Corporal punishments are considered as an act of violence. It cannot be considered to be

a benefit to a child, an issue that can be evaluated from an individual and societal perspective.

Although the direct impact of corporal punishment on children has not received a great deal of

attention from social scientists or child-welfare professionals, Straus in 2013 said "has devoted a

significant portion of his career to the study of corporal punishment and its effects on children.

Work spanning several decades has led Straus to the conclusion that "corporal punishment plays

a crucial role in training people to accept violence in human relationships. What becomes

embedded in the fiber of the child is the acceptance of a relationship between love and violence.
Moreover, because corporal punishment is commonly associated with a parent's concern for the

child, a child learns that it is morally acceptable to strike a loved one.

The view that physical punishment is harmful. In a survey of medical center staff

conducted by Gershoff et al. (2016), less than half of medical center staff agreed that spanking is

harmful to children. Some of Corporal punishments could bring heavy effects to children

especially when hitting the child’s body too much that can cause injuries.

Corporal punishment and physical discipline is not effective and harmless. According to

Benjet & Kazdin in 2003, some people believe that spanking children could bring them in a good

personality and well-discipline. But hitting the body physically could cause inside bleeding and

long-term trauma, also, it could lead them to be a rebel to their parents. Corporal punishments

are known as a kind of discipline system that can teach a child to be educated, manipulative,

respectfull and cotrolling but the fact is, spanking a person is an act of harassment.

Many adults equate discipline with physical punishment were the only way to discipline

a child. Other believe that children who are spanked are discipline and respect authority, while

those who are not are uncontrolled and disrespectful, (Newcombe, 2015). Corporal punishment

is a way to push a child to meditate their mistakes and the best way of disciplining them.

Any human that has ever parented a child recognizes why the reluctance to set a bright

line has been so long lasting and so prevalent. Raising children has never been easy. The

recognition that loss of patience, temper, and restraint is a frequent occurrence in family life is

universally accepted. Spanking and hitting children aggressively will never have the greatest

effect in disciplining youngs. Nowadays, the best way to discipline children is to make them
realize the wrong deeds that they have committed, make light punishments, enough for them to

meditate.
