WHEREBY THE LANDLORD HAS AGREED TO LET THE TENANT RENT THE PREMISES AT

GENERAL TERMS & CONDITIONS

IT IS HEREBY AGREED AND DECLARED between the parties hereto as follows: -

1. THAT the foresaid tenancy shall commence on this ............day of........................... 2019

2. THAT the tenant shall pay to the landlord rent at a rate set as $................... (VEP) in cash per
month to become due and payable before the ............... day of every month.

3. THAT a deposit/bond of $............... together with an advance rent payment for the first month
of $............... to be payable prior to occupying the house. Only the deposit /bond paid is
refundable if only no discrepancies prevail upon vacating the house, which includes electricity,
water bills cleared, fixtures, cleanliness of house/compounds and damages occur during tenants
stay period.

4. THAT the tenancy is for a period of …………………. months minimum that is

there after renewable upon agreed by the landlord and the tenant.

5. THAT tenancy may be terminated at the will of the landlord or the tenant by 28 days’ notice
given in writing. If the Tenant is not able to vacate the flat by the end of the notice to
vacation; then the tenant will have to pay full rent for the next month and Tenancy Agreement
will be still in force until vacated the premises. This period is subject to renewal on the
discretion of the landlord upon mutual agreement in which event, a new contract can be signed.

6. Since the Landlord and the Tenant will be using the same water meter, therefore the bill will be
shared amongst both parties.

7. THAT the tenant shall take proper care of the premises and of all fittings and fixtures belonging
thereto and shall keep the grounds assigned to the premises in clear neat and tidy conditions.

8. THAT the tenant shall not permit or offer any part of the premises to be used for any other
purpose or so as to cause annoyance or inconvenience or nuisance to the occupants of adjacent
or nearby premises.
9. THAT the tenant shall not part with possession of the premises either wholly or in part or
accommodate boarders, or without the previous written consent of the landlord permit the
members of his family, that is his/her legal spouse and their children.

10. THAT the tenant shall not make or permit or cause any alterations or additions to the exterior or
interior of the premises or to any plumbing and electrical apparatus and fixtures without the
consent of the landlord.

11. THAT the tenant shall not keep on the premises or surrounding grounds any livestock including
pets that may cause annoyance or nuisance to other occupants or neighbours.

12. THAT on vacating the house the tenant shall leave in each lighting fixture therein electric bulbs
of good conditions and of the same quality and power and those bulbs provided by the landlord
at the commencement of the tenancy. Clear all payable services such as water and electricity,
cleanness of the house and compound.

13. THAT the tenants shall not interfere with the proper functioning of any sewerage or pipes
provided for drainage.

14. THAT the landlord will not be responsible for any loss or damage to the tenants’ furniture or
other effects caused by fire or any other cause whatsoever.

15. THAT the tenant shall vacate the house at any time when directed to do so by the landlord by
notice given in accordance with the clause 5 of this Agreement and shall comply with any
directions given by the landlord in such notice.

16. THAT any notice, notification, demand or condition given, made or laid down by the landlord to
the tenant pursuant to arising out of this tenancy shall be sufficient if signed by the landlord and
delivered to the tenant.

17. THAT the property at all times remains the property of the landlord.

18. THAT legal civil action may also be pursued in circumstances where disputes arise.

19. Assignment. The tenant is not entitled to assign the tenancy, sub-let any part of the
accommodation, take in lodgers or other paying guests or otherwise part with possession of any
part of the accommodation without the prior written permission of the landlord. The tenant
must not operate any kind of business from the accommodation without the prior written
permission of the landlord. (Parties can mutually agree otherwise).

20. Take reasonable care. The tenant, and those living with or visiting the tenant, will take
reasonable care not to cause or allow damage to be caused to the accommodation, decoration,
fixtures, fittings, furnishings, the common parts and property of neighbours. Walls should not be
nailed and no pasting for of any kind is allowed on the walls using glue, cello tape etc.

21. Security. The tenant and landlord will take all reasonable steps to safeguard the
accommodation against burglary. The tenant will inform the landlord in advance if the
accommodation is to be left unoccupied for more than 14 days.

22. No illegal or immoral use. The accommodation must not be used for illegal or immoral
purposes. Excessive Music or Noise, Smoking and Alcohol are strictly a prohibited act under
this agreement.
23. Rubbish. The rubbish must be put in bins inside the house. The local councils arrange for rubbish
collection must be complied with by putting all the household rubbish in the bin store or other
proper place allocated for it. If no such place exists, rubbish must not be placed anywhere in the
common parts and should be put out for collection only on the day designated for collection.

24. Quiet family prayers can be held without causing any disturbance to the other tenant as,
landlord of the neighbours.

25. Reasonable care and maintenance. The tenant is responsible for taking reasonable care of the
accommodation. This includes carrying out minor routine maintenance, replacement of
appliances and internal decoration. The tenant must keep the accommodation in a reasonable
state of cleanliness and decoration.

26. Repairs through tenant fault. The tenant is responsible for repair (including replacement) of
damage to the accommodation, or loss of any of the fixtures, fittings and items in the
inventory, caused through the fault of the tenant, anyone in the tenant’s house of the tenant.
For the avoidance of doubt the tenant must bear the cost of clearing blocked
drains caused by dirty gully traps, or clearing waste pipes inside individual dwellings where the
obstruction has been caused by misuse.

27. Alterations. The tenant is not entitled without the prior written permission of the landlord to:
 alter, improve or enlarge the accommodation;
 add new fixtures or fittings to the accommodation;
 Nail the walls or any other parts;
 Paste cello tape or glue on the walls;
 install external satellite aerials or dishes;
 erect any type of sign, flag or advertisement visible from outside the accommodation;
 erect a shed, garage or other structure at the accommodation;
 decorate the outside of the accommodation;
 Change any of the locks in the accommodation or add new locks.
 Carry out any electrical work

28. THAT the tenant shall compensate for any repairs and maintenance that is caused by reasonable
wear and tear of the fixtures and property over a period of time of the stay, preferably based on
the tenancy duration and fix any water leakages, pipe eruptions and other damages that is
caused by the tenant’s negligence. Any damage cause by the tenant’s negligence to the
property, owner shall be informed.

OBLIGATIONS OF THE LANDLORD

29. THAT the landlord or any person authorized by him for this purpose may at all reasonable times
enter the house for the purpose of inspection or effecting alteration repairs or additions or for
any other legal purpose whatsoever.

30. THAT the landlord must seek prior permission before entering the premises.

31. THAT the landlord will give notice for any fixed duration of stay or notice of vacation thereafter.

32. THAT the landlord will refund bond money upon tenant satisfying all the terms and conditions
upon vacation [all bills and rubbish to be cleared and no damage to the property]

33. Bond money will not be refundable If tenants vacate premises before six months

34. THAT the landlord denies sub-letting premises.
