CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This agreement is made and executed by and between:

-----, of legal age, Filipino, single and a resident 96 G. Ferraris St.,


---- (hereinafter referred to as the "LESSOR");

-and-

FELY GRACE BUELIS, Filipino, of legal age, with address at


Block 5, Lot 15, Peter Way St., Vincent Heights, Lanang, Davao
City, hereinafter referred to as the “LESSEE”

WITNESSETH

MIKEE BENEVE C. SALA is the owner of Kimrose 5 Unit 13, S. Alaura St. cor. Kabajar Rd.
Brgy Guadalupe, Cebu City.

LESSOR leases unto the LESSEE and the latter accepts to lease the said Residential
Condominium unit under the following terms and conditions:

1. TERM --- This lease commences on May 22, 2021 and shall be in force for ONE (1)
year/s or until May 22, 2022.

2. RENT --- The monthly rental for the leased premises is PESOS: TWENTY
THOUSAND PESOS (P20,000.00) net of taxes; shall be paid upon execution of this
agreement. For this purpose, a yearly Post-dated checks rental shall be issued and
delivered to LESSOR.

3. DEPOSIT AND ADVANCE PAYMENT -   payment of one month advanced and


deposit in the amount of 20,000 each.

The deposit shall be used for any unpaid utilities chargeable to the lessee and any
damage to the property attributable to the lessee.

After 30 days from vacating the premises or after all the utility bills and damages
to the property attributable to the lessee have been accounted for and paid, the
lessor shall return the balance of the one month advanced and deposit, if there is
any.

4. USE OF PREMISES --- The leased premises shall be used exclusively by the LESSEE
for residential purposes only. Illegal and immoral activities are strictly prohibited.

5. SUB-LEASE OR TRANSFER OF RIGHTS --- The LESSEE shall not assign or


transfer his rights in this contract nor sub-lease or sub-let the leased premises or any
portion thereof, under any circumstances whatsoever. Any violation, direct or indirect, of
any stipulation hereof shall automatically and unequivocally terminate this lease contract
from the time such violation occurs and LESSEE shall not be entitled to any refund of
any advanced rental payment.
6. ADDITIONS, IMPROVEMENTS, ETC. --- LESSEE shall not introduce nor install
fixed improvements on the premises without the consent of the LESSOR. LESSEE may
remove its removable fixtures and facilities at its own expense only when it is not in
default in the performance of any of the terms, conditions, and covenants herein
contained; and provided further, that LESSEE shall repair any and all damage caused by
the removal of such properties.

7. SANITATION & REPAIR --- LESSEE acknowledges that the leased premises are in
good and tenantable condition and agrees to keep the same clean and in sanitary
condition.
LESSOR shall be responsible for major repairs except when damages are due to
negligence of LESSEE; while minor repairs shall be to the account of the LESSEE.

8. DAMAGE --- If any damage to the Leased Premises shall occur by reason of the fault,
negligence or misuse thereof by LESSEE, or any of its guests, LESSEE shall
immediately repair such damage at its sole expense. Should LESSEE fail to do so,
LESSOR, shall have the right, but not the obligation, to repair such damage at the
expense of LESSEE and to charge LESSEE for the cost of such repairs plus interest
thereon.

9. UTILITIES and OTHER SUBDIVISION DUES--- The LESSEE shall pay for
electricity, water, telephone. Internet services and cable-tv for the leased premises and
maybe obtained by LESSEE directly from the public utilities. The LESSEE shall also pay
for any subdivision dues or security dues as may be determined by the subdivision
officers or as agreed by the inhabitants of the subdivision.

10. INSPECTION OF THE PREMISES --- The LESSOR or his authorized representative
shall, be previous notice to the LESSEE, have the right to enter the leased premises at any
reasonable hours of the day to examine the same, and during the last one (1) month of
his lease to exhibit the leased premises to prospective lessees, in the event this contract is
not renewed or extended.

11. HAZARDOUS & OBNOXIOUS SUBSTANCES --- The LESSEE shall not keep nor
deposit any obnoxious substances that might constitute a fire hazard.

12. PRETERMINATION --- Should LESSEE opt to pre-terminate this lease contract; he
shall give LESSOR ADMINISTRATOR two (2) months’ notice of his intention. The
security deposit and any advance rental shall be forfeited in favor of the LESSOR.

In case of pre-termination of this lease contract or expiration of the term, the


lessee shall pay all the utilities due therein even after vacating the premises, and
the bills of such utilities arrive at the address wherein it was within the time of
their occupation of the premises. If there was no payment, the deposit shall
answer for any unpaid utilities chargeable to the time their occupied the premises. 

13. EXPIRATION OF LEASE --- Upon expiration or cancellation of this agreement,


LESSEE agrees to return and surrender the leased premises in as good condition as
reasonable wear and tear will permit and without delay whatsoever.

14. RENEWAL/EXTENSION --- Sixty (60) days prior to the expiration of this lease,
LESSEE shall give notice in writing or by email to LESSOR his intention to renew
and/or extend this lease subject to mutually agreed terms and conditions.
15. VIOLATIONS --- The LESSOR may at these options consider this agreement
automatically rescinded and cancelled without any need of any court action, upon ten
(10) days notice given to the LESSEE based on any of the following ground:
a. Failure of the LESSEE to pay rental and other bills or charges therefore
mentioned as they fall due for any reason whatsoever within the period to pay.
b. For any violation made by the LESSEE or its representations of any of the terms
and conditions stipulated in this contract.

16. ABANDONMENT --- In case the leased premises is deserted or vacated before the
expiration of this lease, for a consecutive period of sixty (60) days, or should the
LESSEE be in arrears in payment of rent or other accounts and the premises be closed or
unused without notice to the LESSOR, the LESSOR at its option or sole decision shall
consider the leased premises abandoned and the lease agreement terminated without
notice. In such case, the LESSOR shall have the absolute right to open the premises, take
an inventory of any all furniture and effects and other materials found in the premises,
remove those belonging to LESSEE and place them in storage, for which the LESSEE
shall be answerable for the payment of such storage charges, PROVIDED, that should the
amount deposited by the LESSEE be insufficient to answer for such obligation, the
effects removed and placed in storage shall be considered as taken under constructive
pledge and disposed of by the LESSOR under the applicable provision of the Civil Code
of the Philippines in a public auction of pledged articles and the proceed applied to
LESSEE’s unsettled obligations.

Parties expressly agree that in the unlikely event of suit, venue and jurisdiction shall
exclusively be the courts of Cebu City at the exclusion of all other courts, waiving for
this purpose any other venue.

Provision of penal character in the other sections of this contract shall be construed as
cumulative to the relief granted in this section.
