1. If an engineer is not maintaining professional standards by producing substandard work or lacking integrity, I would first advise the engineer to rectify any mistakes. If no action is taken, I would report the issue to the client and if still no action, report it to the Board of Engineers Malaysia (BEM). 2. Taking over another engineer's work without consent would go against professional regulations. Proper procedures must be followed such as obtaining written confirmation from the client and first engineer. 3. If the first engineer refuses to relinquish responsibilities due to unpaid fees, the new engineer should advise the client to settle payment before taking over work can proceed.

It is clear to you that an Engineer engaged in a particular project (implement at the


taxpayers account) is not maintaining professional standards, i.e professional
competence and intergrity are lacking.
What would be your reaction? Will your report the above incident to the Board of
Engineers, Malaysia or bring this to the attention of the client, or will you maintain silence
and watch substandard work being completed?

Professional standard can be viewed as inadequate or not maintained if the engineer


does not act or follow the regulation. As stated in the regulations, every engineers shall
uphold the dignity and reputation of his proffesion. In carrying out his duty, the engineer
must also safeguard the public interest int the matters related to safety and health. In
other words in discharging his duty (ie whether in design, management or supervision)
he must ensure that he is performing his duties professionally so that his action or plan
will cause no harm to other people or public.
Generally, there are 2 areas often used to gauge the lack of professional standards and
there are :-
i. professional imcompeteance
ii. lack of professional intergrity

In discharging and exercising his duties, an engineer can be considered as professionally


imcompetance due to the following
i. he produces sub-standards and unsound design or work
ii. he is unable to mange the project due to the lack of skills in dealing with
clients, authorities, his subordinates and contracktor.
iii. he is unable to resolve the problems on site due to lack of practical
experience.
An engineer is considered lacking in professional intergrity if he is involved in the
following :-
i. bribery (ie either receiving or giving money) in exercising his duties.
ii. no thought in quality assurance and quality control in discharging his duties.
If I have concrete evidence and reason to believe an engineer is not maintaining
professional standards, the fisrt thing I would do is to advise him so that he can rectify the
mistakes he had made. If there are no actions taken by him, I will report the incident to
the client so that appropriate action can be taken and finally if there is still no action done,
I will bring the matter to the attention of the BEM. It is the duty of an engineer that the
work carried out must comply with the design standard. Sub-standard work cannot be
accepted and shpuld be reported if it can endanger the safety and health of the public.
Once reported, the BEM should take immediate action to rectify the problem and
displinary action should be given to responsible engineer. The displinary action can be
done by asking the engineer to write a ‘show cause’ letter explaining the reason why his
membership should not be terminated or withheld.
In my personel opinion, severe displinary action should be given to an engineer lacking in
profession intergrity as compared with an incompetance engineer. Basically, professional
incompetence is due to the due to the lack of experience and exposure to the
engineering work that he is undertaking. Incompetence engineer should be give a chance
to rectify and correct his mistakes.
7. Under normal circumstances, a consulting engineer should not supplant the work of
another consulting engineer after knowing that the 1 st consulting engineer has already been
entrusted with the work. If he has been asked by the same client to take over the work of that
1st consulting engineering, what do you think should be the proper procedure in effecting this
charge consultants? How should the matter be dealt with if the 1 st engineer refuses to agree
to this change because he as not been paid his fees by the client?

Seorang Jurutera Professional Berdaftar tertakluk kepada Akta Pendaftaran Jurutera 1967.
Di dalam akta dinyatakan bahawa seorang Jurutera Professional hendaklah sentiasa
mempertahankan kemuliaan, kedudukan tinggi dan nama baik professionnya. Sebagai
Jurutera Professional, tanggungjawab dan tugasnya kepada majikan dan pelanggan
hendaklah sentiasa diberi perhatian yang penuh di atas kepentingan awam.

Di samping menjalankan tugas dengan penuh kesetiaan dan tanggungjawab, seorang


Jurutera Professional tidak boleh menggantikan seorang Jurutera Professional yang lain.
Dalam Fasal (3), Akta Pendaftaran Jurutera 1967 dinyatakan:-
i. Tidak boleh menggantikan Jurutera Professional yang lain
ii. Tidak boleh mencampuri urusan Jurutera Professional yang lain.
iii. Tidak boleh mengambilalih tugas atau kerja Jurutera Professional yang lain
melainkan:-
a. mendapat kebenaran/persetujuan daripada Jurutera tersebut.
b. Mendapat pengesahan bertulis daripada pelanggan yang telah menamatkan
khidmat Jurutera Professional berkenaan mengikut syarat-syarat yang
ditetapkan.
Bagi kes di mana pihak pelanggan meminta mengambil alih kerja rekabentuk daripada Jurutera
Perunding yang pertama, antara prosedur dan langkah-langkah yang perlu diambil ialah :-
i. mendapatkan surat pengesahan secara bertulis dari pelanggan yang menyatakan
khidmat Jurutera Perunding tersebut telah ditamatkan mengikut syarat-syarat
perjanjian antara mereka.
ii. jika tiada surat dari pelanggan, surat perlu dihantar kepada Jurutera Perunding
pertama untuk pengesahan. Sekiranya selepas 3 minggu surat tidak dijawab, boleh
dianggap khidmatnya telah ditamatkan.
iii. dengan kebenaran secara bertulis dari Jurutera Perunding pertama untuk Jurutera
Perunding yang baru mengambilalih kerja dan tanggungjawabnya.

Di dalam beberapa kes, surat pengesahan status Jurutera Perunding pertama tidak
diperlukan. Antaranya adalah seperti berikut :-
i. khidmat telah ditamatkan oleh pelanggan secara sah
ii. Jurutera Perunding pertama sendiri menamatkan khidmat dengan pelanggan.
iii. Jurutera Perunding pertama atau pelanggan diistihar muflis.
iv. Jurutera Perunding pertama hilang ingatan / hilang keupayaan untuk menjalankan
tugasnya.
v. Jurutera Perunding pertama telah melakukan prosiding mahkamah dalam menuntut
bayaran perkhidmatan yang tidak dijelaskan oleh pihak pelanggan.
vi. Jurutera Perunding telah tamat pendaftaran dengan pihak Lembaga Jurutera.

Di bawah Akta Pendaftaran Jurutera, hanya Jurutera Professional yang layak boleh
mengemukakan pelan rekabentuk kepada pihak berkuasa tempatan (local authorities).
Pelan-pelan hanya boleh ditandatangan oleh Jurutera yang merekabentuk dan Jurutera
Professional. Begitu juga pengawasan kerja di tapak bina di mana hanya Jurutera
Professional yang boleh memberi arahan dan seterusnya mengeluarkan sijil siap kerja.

Bagi kes Jurutera Perunding pertama tidak mahu melepaskan tanggungjawabnya kerana
pihak pelanggan tidak menjelaskan bayaran perkhidmatannya, Jurutera Perunding yang baru
haruslah menasihatkan pelanggan agar menjelaskan bayaran tersebut. Selagi Jurutera
Perunding pertama tidak bersetuju melepaskan tanggungjawab, Jurutera Perunding baru
tidak boleh mengambilalih.
