Contract of Lease Caloocan
-WITNESSETH-
WHEREAS, the LESSOR agrees to lease-out the above-described unit and the
LESSEE is willing to lease the premises subject to terms and conditions specified in this
Contract;
I. LEASE PERIOD
The lease of the aforesaid property shall be for a period of one (1) year which
shall commence on September 04, 2018 and shall expire on September 04, 2019,
renewable upon such terms and conditions at the option of the LESSOR.
In the event the LESSEE desires to renew this CONTRACT OF LEASE, the
LESSOR shall be notified in writing at least two (2) months before the expiration of this
lease.
II. RENTALS
The parties agree on a monthly rental of FOUR THOUSAND FIVE HUNDRED
PESOS (P4,500.00), Philippine Currency, exclusive of the Electricity, and Water
Consumption.
III. DEPOSITS
Upon the execution of this contract, the LESSEE shall pay to the LESSOR the
amount of NINE THOUSAND FIVE PESOS (9,000.00) representing one (1) months
security deposit and one (1) month advance.
The one (1) months security deposit shall remain in possession of the LESSOR
until such time that all the bills and monthly charges such as water, electricity and any
damages of the premises are fully settled.
In the event the LESSEE fails to go through the full length of the agreed period
resulting to premature termination of the lease, the security deposit shall be forfeited in
favor of the LESSOR.
IV. USE OF LEASED THING
The LESSEE hereby expressly agrees and warrants that the leased thing shall
be used exclusively as a private dwelling house and not for any other purpose and the
said LESSEE is hereby strictly prohibited from using the leased property for any other
purpose without the prior written consent of the LESSOR.
The LESSEE hereby expressly acknowledges that the leased thing is in good
and habitable condition and agrees to keep the same in such good condition. Any
provision of law, present or future, or any stipulation in this agreement to the contrary
notwithstanding, the LESSEE hereby agrees and binds itself to undertake at its
exclusive expense, all repairs, necessary or otherwise, such as may be required to
maintain the same in good state of repair. It is expressly agreed and understood,
however, that the LESSEE shall not start or proceed with any repair work nor in any
case introduce improvements or make any alteration in the leased thing without the
prior written consent and approval of the LESSOR.
The LESSEE shall bring to the knowledge of the LESSOR, within the shortest
possible time, every untoward act which any third person may have committed or may
be openly preparing to carry out on the leased property.
V. INJURY OR DAMAGE
The LESSEE hereby assumes full responsibility for any damage which may be
cause to the person or property of third persons concerning the use of the leased
property. The LESSEE further binds itself to hold the LESSOR free and harmless from
any such claim for injury or damage unless such injury or damage is due to the gross
negligence of the LESSOR.
VI. SUBLEASE/ASSIGNMENT OF RIGHTS
The LESSEE is not allowed to sublease the leased premises under any
condition.
VII. PUBLIC UTILITIES
The LESSEE shall pay during the term of this lease, all charges for water,
electric current, and such other services in the leased premises.
VIII. INSPECTION OF LEASED PREMISES
The LESSOR or his duly authorized representative shall by previous
arrangement with the LESSEE, has the right to inspect the leased premises at
reasonable hours and in a convenient manner.
IX. PRE-TERMINATION
In the event of pre termination of this lease contract by the LESSEE, the
LESSEE shall notify the LESSOR in writing at least sixty (60) days prior to the intended
date of termination. In this case, the two (2) months security deposit shall be deemed
forfeited in favor of the LESSOR.
X. ABANDONMENT
In case the leased premises be abandoned by the LESSEE for two (2) months
without notice to the LESSOR, the LESSOR shall have the right or option to re-lease or
re-let the leased premise to any other person and/or party.
XI. RETURN OF THE LEASED PREMISES
The LESSEE shall return the leased premises, together with the keys thereto,
upon the termination of the lease, just as he received it, save what has been lost or
impaired by the lapse of time, or by ordinary wear and tear, or from an inevitable cause
and without delay whatsoever, devoid of occupants, furniture, articles and effects, and
all improvements introduced thereon removable without doing injury or damaged to the
leases premises.
XII. NON-WAIVER
The failure of the LESSOR to insist upon strict performance of any of the terms,
conditions, and covenants hereof shall not be deemed a relinquishment or waiver of any
rights or remedy the said LESSOR may have nor shall it be construed as a waiver of
any subsequent breach or default of the terms and conditions and covenants shall
continue to be in full force and effect. No waiver by the LESSOR of any of its rights
under this contract shall be deemed to have made unless expressed in writing and
signed by the LESSOR.
XIII. LITIGATION
In the event that any of the parties hereto is obliged to initiate a suit to enforce
the terms and conditions of this arrangement, the parties hereby agree that the party at
fault shall be liable for actual and consequential damages, reasonable attorney's fees
and litigation expenses. Both parties hereby agree that the proper courts in Quezon
City, shall have the exclusive jurisdiction of any litigation between the parties by virtue of
this contract.
