KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT OF LEASE made and entered into this ____ day of __________, at
_____________________________________, Philippines by and between
_____________________, Filipinos, of legal age and residents of
_________________________hereafter referred to as the “LESSOR”.
AND
___________________, Filipino, of legal age, married and is currently residing at
_________________, hereafter referred to as the “LESSEE”.
WITNESSETH
The LESSOR hereby agrees to the LESSEE and the LESSEE hereby agrees to lease from the
LESSOR the property described as follows:
“A residential house, containing an area of approximately _______ sq.mts. with toilet and
bath, receiving area and parking space, referred to hereafter as the “LEASED PREMISES”
located at ________________________________________.”

TERMS AND CONDITIONS


1. TERMS OF LEASE: That the terms of this Lease Contract is SIX (6) months from
__________ to ______________ with provision for a renegotiation of rental rate upon agreement
of both parties.
2. RENTAL: In consideration of this lease, the LESSEE agrees to a fix rental of
_____________________________ per month exclusive of value added tax net of withholding.
3. One-month advance and two months deposit which means that the lessee upon signing the
contract will have to pay one month's rent upfront before moving in. On top of that, the lessee
has to pay two months' rent as a security deposit which covers any willful damage to the property
and any outstanding utility bills that the lessee might incur during his/her rental period. This
deposit, after deducting the above shall be returned to the LESSEE within one (1) month after
termination of this agreement.
4. USE OF LEASED PREMISES: During the terms of this contract, the LESSEE shall use the
aforementioned property exclusively for residential purpose only giving proper care and respect,
as specified by LESSOR and their representatives. Illegal or immoral activities shall be
prohibited. Sublease is strictly prohibited.
5. LESSEE shall not make or permit disturbing noise within premises caused by herself or other
persons under her control nor permit anything to be done by her or such other persons who will
interfere with the rights, comfort or convenience of the neighborhood. LESSEE shall not play or
suffer to be played in the leased premises any musical instruments, phonograph, radio or
loudspeaker or install any machinery or device which may cause or tend to cause noise outside
the leased premises.
6. BILLS: Electricity, cable, telephone bills during the term of this lease shall be to the sole
account of the LESSEE.
7. INSPECTION: The LESSEE agrees that the LESSOR or his authorized representative may at
any reasonable time, with prior notice, enter into the leased premises to inspect or observe the
manner of its use, make alterations or repairs or for any purpose which may deem necessary for
the operation or maintenance of the building or its installations and during the last month of the
term of this lease, to exhibit the leased premises to prospective tenants.
8. IMPROVEMENT, MAINTENANCE, REPAIR AND ALTERATION: LESSEE shall not
make any alterations or improvements without prior consent of the LESSOR. All authorized
improvements or alterations that the LESSEE may undertake on the house or its premises shall
automatically become the property of the LESSOR without any obligations on the part of the
LESSOR to reimburse the LESSEE for the expenses incurred by the reason or such
improvements or alterations.
9. SANITATION AND REPAIR. LESSEE shall keep the house and its premises clean and in
sanitary condition and shall take good care of the leased premises as good as father of the family.
The LESSOR agrees to keep the premises in good and tenantable condition and shall be
responsible to necessary MAJOR repairs, repair such as defects of the structural nature. Likewise
having regard to the condition at the commencement of the lease, LESSEE acknowledges that
the same is in good and tenantable condition and agrees to keep the same in all respect in good
substantial repair and working order and condition. MINOR repairs shall be at the exclusive
account of the LESSEE.
10. HAZARDOUS AND OBNOXIOUS SUBSTANCE. The LESSEE shall not or deposit any
obnoxious substance that might constitute as fire hazard, except gasoline in vehicle.
11. RULES AND REGULATIONS: LESSEE agrees to abide by the rules and regulations
established by and those that may be promulgated from time to time by the LESSOR.
12. RENEWAL: LESSEE shall give notice to LESSOR two (2) months before the expiration of
this Contract of Lease, of her intention to renew this Contract, subject to agreement of rental rate.
13. EXPIRATION OF CONTRACT: Upon expiration of the terms of this Contract of Lease as
herein provided, LESSEE will promptly deliver said PREMISES to LESSOR in as good and
tenantable wear and tear expected, devoid of all occupants, furniture, articles and effects of any
kind belonging to the LESSEE, provided however, that the non-compliance will give LESSOR
the right to refuse acceptance of the premises and to compel the LESSEE to pay the same rate of
rental as herein provided, plus 50% of the rental as penalty until the LESSEE shall refuse to
leave the premises after her right of lease has expired or been terminated.
14. PRE-TERMINATION: Pre-termination is not allowed. In case of pre-termination of contract
by the LESSEE, the two months deposit will be forfeited in favor of the LESSOR.
15. VENUE OF ALL ACTIONS: All actions arising from this Contract shall be in the proper
court of the municipality of _______________
16. TERMINATION: Violations of any of the terms and conditions of this Contract by the
LESSEE shall give the LESSOR the option to terminate the Contract of Lease.
