Affidavit of Confirmation of Sale - Aviso
AFFIDAVIT
KNOW ALL MEN BY THESE PRESENTS:
I, JANES O. AVISO, of legal age, Filipino, single, and a resident of and postal address
at Barangay Siapo, San Jose, Negros Oriental, after having been duly sworn to in accordance
with law, do hereby depose and state:
1. That the surviving heirs of the registered owners of a certain parcel of land known as Lot
No. 3691, covered by Transfer Certificate of Title No. T-8052 located in the Municipality of
San Jose, Negros Oriental, caused the subdivision of the said parcel of land and agreed to
orally partition the parcel of land into: Lot No. 3691-A, Lot No. 3691-B, Lot No. 3691-C
and Lot No. 3691-D;
2. That Lot No. 3691-C is orally partitioned in favor of the late EUGENIA ZERNA (married
to LUCAS AVISO) by virtue of a Subdivision Sketch Plan surveyed by Rodolfo B. Ridad.
Furthermore, EUGENIA ZERNA-AVISO was survived by her children, including
PEDRITO AVISO;
3. That PEDRITO AVISO died on August 24, 1987 and was survived by eight (8) children,
including herein Affiant;
4. That By virtue of intestate succession, the herein Affiant is one of the lawful owners of the
parcel of land that was partitioned to EUGENIA ZERNA or Lot No. 3691-C;
5. That By virtue of the further subdivision of Lot No. 3691-C caused by herein Affiant and
her co-owners, Affiant therefore became the owner of a portion of Lot No. 3691-C known
as Lot 3691-C-1-C with the following metes and bounds:
LOT 3691-C-1-C
1-2 S 40°51’E 90.92 m.
2-3 S 50°53’W 19.19 m.
3-4 N 40°51’W 88.66 m.
4-1 N 44°08’E 19.26 m.
6. That for and in consideration of the sum of FIFTY THOUSAND PESOS (Pho 50,000.00),
I sold the above-described Lot No. 3691-C-1-C to Spouses RICKY O. AVISO and
BIBINA R. AVISO by virtue of a Deed of Absolute Sale dated May 23, 2018 and
recorded under the notarial registry of Atty. Froilan Joseph B. Pinili as Doc No. 160;
Page No. 32; Book No. 1; Series of 2018;
7. That I hereby AFFIRM, CONFIRM, and RATIFY the said sale in favor of the Spouses
RICKY O. AVISO and BIBINA R. AVISO;
8. That I am executing this Affidavit to attest to the truth of the foregoing facts to the effect
that I confirm the sale of the above-described portion of Lot No. 3691-C known as Lot
3691-C-1-C to the Spouses RICKY O. AVISO and BIBINA R. AVISO, and for whatever
legal purposes this may serve best.

9. That the abovementioned parcel of land does not come under the operation of the
Comprehensive Agrarian Reform Program.

ACKNOWLEDGEMENT
SUBSCRIBED and SWORN to before me this 14th day of January, 2021, personally
appeared Principal who is known to me and identified by me by competent evidence of identity
in accordance with the 2004 Rules on Notarial Practice, who exhibited to me the above
identification card, who executed this foregoing Special Power of Attorney and acknowledged
that the same is her free and voluntary act and deed. This instrument consisting of one page,
including this page whereon this acknowledgement is written has been signed by Principal.
