Executive Order No. 2018 - 04

AN ORDER REORGANIZING THE BARANGAY ANTI-DRUG ABUSE COUNCIL (BADAC) OF


BARANGAY STA. CRUZ, IBAJAY, AKLAN

WHEREAS, the increasing use of illegal drugs has significantly contributed to the incidents
of heinous crimes and a perennial to society;

WHEREAS, the barangays, as the first line of defense, should lead the fight against illegal
drugs through the campaign, “Mamamayan, Sugpuin and Iligal na Droga” (MASID);

WHEREAS, Section 16 of the Local Government Code of 1991 provides that local
government units shall pursue undertakings to improve public morals and maintain peace and order,
among other equally significant concerns;

WHEREAS, DILG Memorandum Circular No. 2015-63 dated June 16, 2015 enjoins the
revitalization of the Barangay Anti-Drug Abuse Councils (BADAC) and specifies their role in Drug
Clearing Operations;

NOW THEREFORE, I, DELMAR D. DUMALAOG, Punong Barangay of Barangay Sta. Cruz,


Ibajay, Aklan, by virtue of the power vested upon me by law, do hereby order the reorganization of
Barangay Anti-Drug Abuse Council (BADAC) of Barangay Sta. Cruz, Ibajay, Aklan.

Section 1. COMPOSITION. The Barangay Anti-Drug Abuse Council will be composed of


the following:

Members : CARMELA M. SANTIA, SBM, Chair of Women & Family
SHERWIN S. CASTRO, SK Chairperson
ROSEBELLA S. FERNANDEZ, Teacher In-charge/Principal
ELIODORO T. TUMBOCON, Chief Tanod
ROY M. SUMANTING, NGO Representative (GUARDIANS)
MARIALYN P. VALENZUELA, PTA Representative

Section 2. ROLES AND RESPONSIBILITIES. The Powers and Functions of the council
will
be as follows:

a. Conduct regular meetings at least once a month a call for special meetings whenever
necessary;
b. Plan, strategize, implement and evaluate programs and projects on drug abuse
preventions in the barangay;
c. Organize the BADAC Auxiliary Team compose an ideal number of 25 members per 2000
population of barangay representing streets, puroks, subdivisions or sitios;
d. Orient the BADAC Auxiliary Team of their roles and functions and in formulating plan of
action to address the problem;
e. Equip barangay Tanod and BADAC Auxiliary Team on their roles and functions in the
campaign against streets level illegal drug trade through seminars or trainings;
f. Coordinate and collaborate with other institutions implementing programs and projects
on drug abuse at the barangay level.
g. Continuously gather and update data on drug abuse and its effect on the peace and
order situation in the barangay including listing of drug users and pushers.
h. Submit a Monthly Report to the MADAC copy furnished the DILG Field Office/MLGOO.
i. Refers users and pushers to the MADAC and other institutions for corresponding
counseling and/or rehabilitation;
j. Monitor disposition and progress of drug related cases filed; and
k. Perform other related functions.

Section 3. BADAC Committees. The BADAC shall be composed of Committee on


Operations and Committee on Advocacy as follows:

Section 3.1.1. Roles and Responsibilities

 Prepare and maintain a confidential list of suspected users, pushers, financiers and/or
protectors of illegal drug trade found in the LGU’s area of jurisdiction to be submitted to
the MADAC copy furnished the PNP-Anti-Illegal Drug Special Operations Tasks Force
(AIDSOTF); and
 Established Rehabilitation/referral desks and process application for rehabilitation of
drugs dependents.

Section 3.1.2. Pre Operations

 Identification of drug affected house, clusters, work places, streets, puroks and sitios
where manufacture, sale or use illegal drugs are being conducted and to report the same
immediately to the PNP or the Philippines Drug Enforcement Agency (PDEA).
 Conduct administrative searches of suspected drug dens/laboratories.
 Conduct briefings, meetings prior to the launching of operations to ensure positive results
and safety operating teams and community.

Section 3.1.3. During Operations

 Ensure safety of the community and regularity of the operations.


 Any elected barangay officials present during the operation to witness the inventory of
seized drugs/paraphernalia.
 Extend such other necessary assistance to the PDEA and PNP authorities in its
operation against illegal drugs including but not limited to the preservation of evidence
and protection of witnesses and suspects against unlawful acts

Section 3.1.4. Post-Operation

 The elected barangay official present during the operation shall execute an affidavit and
acts witness in court hearings in the prosecution of drugs cases.
 Submit reports of drug-clearing operation conducted, if any, to the City/Municipality Anti-
Drug Abuse Council copy furnished the DILG City/Municipality Field office.

For operations conducted/initiated by the PDEA/PNP, an elected barangay official should


be involved immediately after the raid and be present to stand as witness during the
conduct of inventory.

Section 3.2.1. Roles and Responsibilities

 Coordinate and collaborate with other institution in the barangay if any (i.e. Barangay
Intelligence Network (BIN), “The Eye in the Barangay,” Barangay Peacekeeping Action
Team (BPAT), etc. in implementing programs and projects on anti-illegal abuse;
 Conduct consultative meetings with organizations, in the barangay, such as the Parent
Teachers Association (PTA), Youth Groups, Boy and Girl Scouts, religious organizations,
senior citizens, homeowner associations, neighborhood association, puroks and Tricycle
Operators and Drivers Association (TODA) and other organization existing in the
community to get their commitment to assist in curbing the drug menace in the
community;
 Strengthen the family by promoting values, parental care and guidance that will prevent
children from attempting to and/or use of prohibited drugs;
 Strengthen the linkages of the Barangay Officials with the community, higher LGUs, local
police and PDEA on anti-illegal drug campaign;
 Conduct necessary seminars for the community on the dangers of illegal drugs in
coordination with the PNP;
 Empower the community in reporting drug related cases through an
award/commendation system;
 Identify and implement sustainable livelihood projects as a reintegration program to
former drug pushers and drug addicts.

Section 4. Effectivity. This Order shall take effect immediately.
