Nalbert Ian P. Gasal sold a house and lot to Gremar John B. Tazarte through a deed of sale in November 2021. However, the original title is still held by Pag-IBIG pending release of the mortgage. Gasal undertakes to deliver the original title to Tazarte once the mortgage is released. He also guarantees that his heirs will recognize the sale and not make claims on the property. Further, Gasal agrees to be liable for any damages caused by his failure to comply.

AFFIDAVIT OF UNDERTAKING

I, NALBERT IAN P. GASAL, of legal age, Filipino Citizen, single and residing at
Blk. 12 Lot 32 San Fernando Heights Malpitic, San Fernando, Pampanga, Philippines,
after being sworn to in accordance with law, depose and state:

1. That I am the seller of a house and lot situated at Blk 3 Lot 16 Greenmark Homes
Extension, bgy. Malagasang II-B, Imus, Cavite and covered by TCT No. 057-
2016074589 issued by the Registry of Deeds of Cavite;

2. That I sold the aforesaid property to GREMAR JOHN B. TAZARTE by virtue of


Deed of Absolute Sale with Assumption of Mortgage dated November 20, 2021,
recorded as Doc. No. 121; Page No. 26; Book No. XCVIII; Series of 2021 in the
Notarial Registry Book of Atty. Marvyn L. Maristela of Imus, Cavite;

3. That I understand that the copy of Original Transfer Certificate of Title has not yet
delivered to the buyer since the same is still in possession of Pag-IBIG
Fund/HDMF pending release of mortgage;

4. That I hereby undertake that this sale, transfer, cede and conveyance of the
above subject property by virtue of Deed of Conditional Sale with Assumption of
Mortgage and Deed of Assignment and Transfer of Rights binds my heirs,
assigns and successor-in-interest;

5. That in the event of full payment of the subject property by reason of the
application of Mortgage Redemption Insurance, my heirs, assigns and
successor-in-interest shall execute a waiver renouncing their rights and interest
over the subject property in favor of the BUYER/VENDEE;

6. That this undertaking will serve a notice to my heirs, assigns and successor-in-
interest their obligation in the event of the occurrence of death;

7. That I hereby further undertake to guaranty the delivery of the original copy of the
Transfer Certificate of Title as soon as the mortgage has been released and
delivered to my heirs, assigns and successor-in-interest by the aforesaid transfer
certificate of title by Pag-IBIG Fund/HDMF;

8. This is without prejudice to the right of the SELLER/VENDOR to initiate further


legal action for the damages they may incur by reason of my non-compliance.

Further sayeth none.
