Special Conditions
1. The TENANT shall at the TENANT’S expense replace all lighting tubes and globes to the premises which become defective during the
term of the tenancy unless the defect is proven to be caused by faulty wiring.
2. The TENANT agrees to fully and regularly maintain and water the garden area, including weeding garden beds, trimming shrubs,
inclusive of mowing the lawn and removing all garden rubbish from the property unless otherwise specified in the special conditions.
3. If the TENANT wishes to vacate the premises at the expiration of this Agreement the TENANT shall give the LANDLORD or AGENT
written notice of the TENANT’S intention to vacate 28 days prior to the expiration of the Agreement. If the TENANT remains in occupation
of the premises after the expiration of this Agreement and does not enter into a new fixed term Agreement the TENANT must give written
notice of the TENANT’S intention to vacate the premises specifying the termination date that is not earlier than 28 days after the
day on which the TENANT gives notice.
4. The TENANT acknowledges that pursuant to Section 428 of the Residential Tenancies Act, 1997, the TENANT shall not refuse
to pay rent on the ground that the TENANT intends to regard as rent paid by the TENANT the BOND or any part of the BOND paid
in respect of the premises. The TENANT acknowledges that failure to abide by this section of the Act renders the TENANT liable to a
penalty of $1000.
5. The TENANT agrees to notify the LANDLORD’s Agent of any change of mobile and email address number in writing.
6. In the event that the TENANT intends to vacate the property prior to the expiry of the Lease, the TENANT agrees to pay the all
letting costs (2 weeks rent) plus advertising of $360 (including GST) plus all rental payments up until the lease expiry date.
7. The TENANT will not change any locks on the property without the prior consent of the Landlord/Agent and the agent must be
supplied with a key to any new lock once the consent has been given.
8. In the event that the commencement of tenancy is subject to a settlement of the premises, the Landlord and Agent takes no
responsibility for any inconvenience caused and is not liable for any costs involved should the premises not be available on the original
commencement date.
9. It is hereby agreed that the TENANT/S will maintain additional services such as satellite dishes, TV Antenna, Foxtel, Optus Vision,
internet connections etc. Should the TENANT/S wish to install any services other than what is currently provided, it must be at the
TENANT/S cost and with the strict permission of the LANDLORD/S. The TENANT must put a request in writing to the agent.
10. THE TENANT FURTHER AGREES THAT ANY INSTALLATION OF ADDITIONAL SERVICES that are added to the
premise of this nature are to be removed from the premises at the expiration of the tenancy at the tenant’s expense and reinstate the
premises to the landlord’s discretion.
11. *Fully qualified and approved technicians must be employed to carry installation and removal works. The tenants acknowledge it is their
responsibility to check the availability of phone and/or internet connections to the property. The Landlord and/or Agent will not accept any
responsibility for the delay of phone/internet connections caused by the providers.
12. The Tenants acknowledge and agree that they will affix furniture protectors to any furniture which comes into direct contact with any
polished floors at the property to ensure no damage such as scratches or indents occur to these polished floors including the wearing
of stiletto shoes. The Tenants also acknowledge and agree that if there are existing floating timber floors, no large amounts of water is
to come into direct contact with the surface area and when cleaning only damp mops or cloths are to be used.

13. The Tenants acknowledge and agree that they will NOT clean any stainless steel or glass surfaces with any harsh abrasives or
scouters which would cause scratching or damage to these surfaces. The Tenants acknowledge and agree that it is their
responsibility to make their own enquiries as to the care and maintenance of any stainless steel or glass surfaces.
14. It is the tenant’s responsibility to collect any meter numbers for gas and or/electricity to the property for their service providers.
16. The TENANT agrees to six monthly inspections of the property with digital photos taken for the landlord’s records of condition of
property and any maintenance required.
17. If in the event the tenant changes the routine inspection date and or time after the second confirmation of routine inspection date, a
payment of $50 applies for it to be rescheduled.
18. It is agreed between landlord and tenant that the adults as specified in the lease schedule page have been approved to reside at the
property. No further occupants are to reside at the property without the prior written consent of the landlord and/or Agent.
19. It is agreed between landlord and tenants that it is strictly prohibited to allow short or long term guests to reside in the premises,
including utilising companies such as but not limited to, AirBnb, Roomorama and Marketplace
20. The TENANT agrees that it is their responsibility to keep the pool (if applicable) in a well-maintained, safe condition. The pool must be
clean and vacuumed, water balanced, filter cleaned and timers set (where fitted). All pool equipment must be accounted for and securely
stored. A certificate is to be supplied by a reputable pool service company once every month authenticating the condition of the pool
and water. If it is noted that the pool is not being maintained, you will be given 48 hours’ notice to rectify the problem. Failure to comply
with this will result in a professional pool cleaner attending the property. The tenant agrees to pay for any associated costs to restore the
pool to its original condition, if caused from tenant neglect
21. The TENANT understands and agrees to regularly clear debris and leaf litter from the filter basket on rainwater tanks.
22. Tenants hereby acknowledge and agree that they are only to use the nominated bins supplied by council for rubbish removal and are
not to dump further rubbish on their nature strip. Tenants acknowledge and agree that they will abide by council rules and regulations
when utilizing the annual Hard Rubbish Collection period provided by council. Tenants are required to report any unknown rubbish
on their nature strip immediately to their respective council to arrange collection.
**Failure to adhere to the above may result in fines of up to $500 from council.
23. Keys, Swipe Cards and Remotes. During business hours (9 am to 6pm weekdays within a 20km radius of Chadstone) - subject to staff
availability, a representative of Nexus Real Estate can unlock doors for a fee of $100.00. A photo ID will be required to confirm identity of
tenant and payment of $100.00 is required at time of service.
- After hours or outside the 20km Chadstone radius - tenants will have to organise own locksmith to unlock doors. In the event that locks
are changed, two sets of new keys must be given to Nexus Real Estate.
- Tenants must immediately report all lost keys to Nexus Real Estate
