Reference: Case No-170, Date:28/03/2024,Mohammadpur PS,Dhaka Metropolitan Police.

Dear Concern,

Detective Branch (DB, DMP) Unit of Bangladesh Police is investigating a Case No-170,
Date:28/03/2024,Mohammadpur PS,Dhaka Metropolitan Police. Another fake Facebook ID was created
by collecting various pictures of GD victims from Facebook. From the said fake ID, various people in
the victim's mutual friend list are added as friends, spreading bad impression about the victim. As a
result of this continuous spread, the victim is broken humanly. The victim contacted the fake Facebook
ID and requested to stop it. But the victim is offered sex from the said fake ID. As the mental condition
of the victim is serious, his guardian requested us to take legal action against the said guilty person.
According to the prevailing law in Bangladesh, sexually harassing someone or operating a fake account
using someone's name and photo is a punishable crime. In order to bring the guilty person under the
law, it is important to know the mobile number and IP address used by him and the verified email
address as well as his geographical location. Also requesting to close the mentioned Fake ID.

So, I request you to provide us the following records against this Facebook ID: 61557652419291

1. ID creation time, date, place, E-mail address and mobile number.


2. Log In details IP from 04 October 2023 to 04 April 2024 and last log in IP.
3. It is necessary to know the geographical location of the accused facebook ID.

In Bangladesh, your facebook information is considered extremely important, so, here to ensure the
security of information and bring the fake ID user under the law, the digital security act 2018 has been
introduced. So your prompt response in this regard would be highly appreciated.

Legal provisions under which data is requested:

A. Under section 46& 55 of Digital Security Act, 2018:


Help In Investigation&Regional and International Assistance: -
The Investigation Officer while conducting investigation of an offence under this Act may request any
person or entity or service provider to provide information or for providing assistance in the
investigation and on such request the person, entity or service provider will be bound to help the
Investigation Officer.
If regional or international assistance becomes necessary while conducting an investigation or trial of an
offence under this Act, then, the provisions of Crime Related Interpersonal Assistance Act, 2012(Act
Number IV of 2012) will be applicable.\

B. Under section 76 of ICT Act, 2006 (Amendment 2013):


Investigation of crime, etc:-
(1) Whatever is contained in the Code of Criminal Procedure, the Controller or any officer authorized
by the Controller, or any police officer not below the rank of Sub-Inspector of the Police shall
investigate any offence committed under this Act.

C. Under section 94 of Code of Criminal Procedure, 1898:


Summons to produce document or other thing: -
Whenever any Court, or any officer in charge of a police-station considers that the production of any
document or other thing is necessary or desirable for the purposes of any investigation, inquiry, trial or
other proceeding under this Code by or before such Court or officer, such Court may issue a summons,
or such officer a written order, to the person in whose possession or power such document or thing is
believed to be, requiring him to attend and produce it, or to produce it, at the time and place stated in the
summons or order.
