SUB: LEGAL NOTICE UNDER SECTION 138, OF THE NEGOTIABLE INSTRUMENTS ACT, 1881

Dear Sir,
I act for and under the instructions of my client Mr. Sanjay Singh, Daryaganj, Jabalpur- 420008 (herein
referred to as ‘my client’).I hereby serve upon you the addressee, the present demand cum legal notice
in terms of the facts and circumstances stated hereunder, I serve you with the following notice:
1. That my client is engaged in the business of trading of supplying machines for the purpose of
industry manufacturing, for last several years and enjoys immense goodwill and reputation, for
services rendered. During the ordinary course of business you addressee purchased from my
client the said machines for which you issued a cheque bearing no. 567386 dated 4/08/2024 of
Brass Bank of India, Sadar Branch, Sadar, Jabalpur- 420008 for a sum of Rs.7, 00,000/ -as part of
payment towards discharge of your liability which you address had incurred by way of
purchasing aforesaid machines from my client.
2. That the above mentioned cheque was deposited by my client with his banker Sunflower Bank
of India, Nayagaon Branch, Rampur, Jabalpur- 42000, for encroachment on 4/08/2024.
3. That the said cheque was returned to my client with an endorsement “Dishonored for
insufficiency of funds.” That the dishonored cheque along with the cheque returning memo of
bank dated 5/08/2024 was returned to my client.
4. That for the first time my client came to know about the dishonoring of the said cheque on
5/08/2024.
5. That on account of the dishonoring of the cheque you addressee are guilty of committing
offences punishable u/s 138 of the Negotiable Instruments Ac, 1881 (as amended up to date)

In view of the facts and circumstances stated here in above, we, on behalf on our client, hereby call
upon you to make payment of Rs. 7,00,00/- thereby honoring the aforesaid cheques within a period of
15 days from the date of receipt of this demand cum legal notice.

You are hereby called upon to comply with the requisitions contained in this demand cum legal notice
failing under which our client shall be constrained to institute both civil as well as criminal proceedings
against you including a criminal complaint against you the Notice under Section 138 read with Section
142 of the Negotiable Instruments Act, 1881 besided recovery proceedings before the appropriate court
of law and in such an event you the notice shall be liable for all the costs and expenses incurred by our
client and the consequences of litigation(s).

A copy of this notice has been retained in our office for further necessary action.
