Task 1: The influence of peers

Question 1
The comments on the influence of peers on health and safety at the car showroom are as
follows:
1. The senior salesperson suggests that due to any mishaps the profit and bonuses
can be wiped out easily of the company in addition to that there would be unwanted
attention of media and enforcement agencies.
2. In the past times the senior salesperson has fearlessly raised his point about the
issue regarding the safety of the fire evacuation safety with the Managing Director
(MD)
3. The sale supervisor has strong influence on people reporting to him and he even
has 5years service experience
4. The reports of regional, national, international boards and the responsibility for
meeting their sales targets is delegated to the Head of sales (HOS) by the
managing director
5. The apprentice is asked by the sale supervisor to move a car at a hardstanding
location right in front of the entrance
6. The sale supervisor influenced the apprentice to not report the incident by saying it
is a matter for you, and you alone; as long as you don’t say a word to anyone else,
neither will I’’, and promised to spare his embarrassment
7. The apprentice is influenced by the salesperson and is advised to say that he fell of
a bike if anyone asked
8. The implications of accidents at work are informed to the apprentice by the senior
salesperson who is suspicious of him
9. Experienced peer pressure. If management is only concerned with the bottom dollar
and meeting schedule, the workplace culture and safety will suffer. It is probably
more accurate to this as peer influence : adopting a set of behaviors in order yo be
accepted as part of a group of your equals.
10. Without the health and safety team the sales target by management of selling cars
are not asking questions about safety or quality or workplace culture.

Task 2: Emergency procedures

Question 2 (a)
The positive points about fire safety arrangements at the car showroom are as follows:
1. In the scenario where the sales apprentice thinks its humorous to use the fire
extinguisher to wake up sales supervisor we see that the fire extinguisher is
available for any mishap
2. As many families visit this car showroom we see that a fire call point was available
if any incident were to happen as seen in the scenario where a child uses it as a
false alarm.
3. Emergency procedure is available as mentioned that the visitors and workers were
escorted and assigned to the assembly point by the sales supervisor who had
assumed the role of fire marshal,
4. As any incident should be recorded, we see that one fire related incident had
occurred and was recorded by them
5. As seen in the conversation between senior sales person and sales supervisor
which finished by pointing out that there are fire actions notices around premises

Question 2 (b)
Negative points about fire safety arrangements at the car showroom are as follows:
1. On one of the fire call points that read ‘break glass, press here’, which a child read
and did exactly as written instructions were wrong and not clear
2. Miss use of fire extinguisher by young worker who tried to fit in and thought it was
humorous to use it on the sleeping supervisor this shows how much untrained he
is
3. Only one fire incident was recorded even though fire incidents occurred many times
which shows how less the management cared about the safety
4. When the child pressed the alarm the sale supervisor assumed the role of fire
marshal although untrained, not even the workers were aware of what they had to
do as no one could remember ever practicing the emergency procedure.
5. After the senior sales person raised his concerns regarding the safety mock drills
the sale supervisor replied that the management did not feel an overall fire risk
and said there was no need to practise frequent fire drills
6. The sale supervisor had to assume the role of fire marshal. As no fire marshal was
appointed which shows negligence towards safety.
7. No one was trained regarding the responsibilities and duties of fire marshal as no
one was appointed as fire marshal.
8. As not mentioned in the scenario we assume that no fire hydrant was available to
tackle fire if there had been any incident.
9. Workers being unaware of what to do in emergencies shows irresponsibility of the
management.
10. As not mentioned in scenario we assume that there was no fire exit sign which
shows carelessness of management.

Question 2 (c)
Importance of practice emergency procedures are as follows:
1. Even after taking all the correct safety measures there is still room for things to go
wrong due to irresponsible management behaviour
2. Management needs to take proper security measures like making available fire call
point, fire extinguisher, fire exit door, fire hydrant, fire exit sign, etc. This helps to
protect lives of various peoples.
3. Workers should be trained and made aware of their roles and responsibilities in
case of emergencies.
4. Induction training, mock drills, etc should be practiced frequently to make people
competent in handing emergency.
5. Workers should be trained to act quickly and effectively which would help ease the
situation and reduced the consequences as well as reduced the damage on plant
and equipment.

Task 3: Accident reporting

Question 3 (a)
Comments on the sales supervisors approach to reporting the apprentice’s accident are
as below:
1. Sales supervisor witnessed the incident of the apprentice tripping over a seatbelt
which was not fully retracted, while answering on his phone which was witnessed
by the sale supervisor who took no action of reporting.
2. Due to poor decision making from sale supervisor of letting the apprentice go
without being penalized and thought the event was harmless looking incident.

3. the sale supervisor negatively influenced the young apprentice saying, “It is a
matter for you, and you alone; as long as you don’t say a word to anyone else,
neither will I”
4. Sale supervisor did not report the accident of young apprentice which showed
negative culture of behaviour.
5. The sale supervisor tried to cover up by advising the young apprentice to give a
false statement saying that his injury occurred due to falling from bike at home.

Question 3 (b)
Apprentice accident should be reported by the employer as follows:
1. Online responsible people reporting should complete all the appropriate online
report form listed below.The form then shall be submitted directly to the RIDDOR
database.
2. Any accident or mishap shall be notified directly and internally to directors, senior
managers, Human resources managers health, safety and environmental
advisers, worker representatives by mail.
3. Telephone-all incidents can be reported online but a telephone service is also
provided for specific incidents.
4. The family will be notified about the injured person directly by calling on phone of
any family member in case of any incident or accident of fatal injury.
5. Daily morning Tool Box Talk will notify the workers and will be displayed on notice
board.Tool Box Talk spreads awareness to workers.

Task 4: The legal reasons for health and safety management

Question 4
The legal reasons for managing health and safety are as follows:
1.Managing workplace is one of the most important part of management, not being
able to manage workplace will be failure to achieve these legal minimum standards which
may lead to enforcement action by authorities
2.Not being able to manage work place will be treated as failure to achieve legal
minimum standard which can also lead to prosecution before the courts in term of fines.
3.Laws are made to protect humans and their rights hence it works all over the world
and it compels the employer to treat his employees with reasonable care.
4.Law was created to help the government function, and it also defines the framework
that governs the conduct of business and organization.
5.Law imposes obligation over many things for which one needs to obtain license from
the government and in order to get a license one needs to oblige to local laws.
6.Employees are able to sue in civil court for compensation claims by providing
negligence of the employer under the compensatory effect of law.
7.Law also protects from punitive damage where the criminals prosecution due to
breaches of legal duty may result in a fine for organization and imprisonment or fine or
both to individuals.
8.Criminals get imprisoned but not managing workplace can also lead to prosecution
before the court in term of impresionment.
9.A business can be suspended by court or by majority votes between board of
directors or in case of partnership mutual agreement not managing workplace can also
lead to prosecution before the courts in terms of suspension of continuity of business.
10.Failure to achieve minimum standards set by laws can lead to enforcement actions
ans prosecution before the court.

Task 5: Workers’ responsibilities in the workplace

Question 5

Below are the duties of young apprentice as per article 19 of C155 and recommendation
16 of R164 may have been contravened
1. He might have contravened to perform his work and to co-operate with emplyer to
fullfill his legal duties
2. He might have contravened to co-operate to promote health and safety at the car
showroom which might have led to the accident
3. He have contravened to to report his immediate supervisor of situation which is
dangerious and can lead to accident

Task 6: Near misses

Question 6
Investigation of the previous near misses could have helped prevent this accident as
follows:
1. To investigate previous near misses one should have understanding of how and
why things went wrong in that particular incident and should work on it, so that it
does not happen in near future.
2. Management should have an understanding of conditions or substances to which if
exposed may bring harm to one’s health.
3. There are no shortcuts in health and safety department, it gives a true idea of what
really happens practically and how work is really done in fields.
4. It is important to identify inadequacy in your risk control management which will
help you identify and tackle risk in the future and learn lessons which would help
you or other parts of your organisation.
5. One can identify management failures if near misses keep happening and is
ignored by the management.
6. To prevent such near misses in the future management should develop better
health and safety culture or else there is a chance of a serious accident in the
upcoming period.
7. Management needs to understand the importance of implementing safety
precautions to prevent further adverse effects.
8. Management should focus on developing their managerial skills which can help
other areas of the organisation.
9. Management should apply more emphasis on improving employees morale and
attitude towards health and safety.

Task 7: Health and safety culture

Question 7
Negative indicators of health and safety culture at the car showroom are as follows:
1. By giving total freedom to sales team to do anything and achieve their sales target.
As a result most of the sales team took chances to maximise bonuses for the
greater good of the team.
2. The young apprentice trying to fit in thought it was humorous to misuse fire
extinguisher As the young apprentice being of 17years of age and not being a
major i.e .of 18years age hence not being legal age it is a fault in management
hence it shows negative management.
3. Management focused mainly on achieving sales target and bypassing health and
safety due to his incompetency and immaturity.
4. The apprentice being inattentive while parking the vehicle by using mobile phone
while driving and was being careless.
5. Apprentice being a minor and inexperienced due to lack of knowledge, training and
supervision had a very short induction.
6. The management failed in recording incidents related to fire and only recorded one
incident in past 12years which was a false alarm.
7. The sale supervisor suggested that the management felt the overall fire risk was
low and there was no need for frequent fire drills.The workers stayed oblivious in
emergency situations as none of them remembered practicing the emergency
procedure.
8. Senior sales person felt a lot of peer pressure while fitting in the rest of the group
and not worry about insecure working conditions.
9. Head of sales(hos) even after having 10years of work experience at the showroom
was not trained enough to fulfill the role of health and safety and prioritized the
sales target.
10. Even MD did not find any reason to challenge the unsafe behaviours of not
looking after health and safety,they only wanted to meet their sales target with a
successful team.
11. MD having negative thought process replies that, “people luckily escape from
incidents that could have been more serious. But nothing bad has happened so
far, so why worry?” is the negative behaviour of MD.
12. Sales supervisor made a poor assumption that the event is harmless looking
incident, influenced the young apprentice to not report the accident.
13. Sale supervisor negatively influenced and advised to say that the injury occurred
due to falling from bike at home.
14. Due to management paying close to no priority in health and safety of workers,
the staff turnover rate is high as workers don’t stay long enough to be influenced.
15. The senior sales person was pressurised by his peer’s to not take unsafe
conditions seriously and let it become a common practise this called interpersonal
issues between peer’s.
16. Due to poor management system and procedure and lack of management
commitment to safety and also presence of blame culture, the workers do not
prefer working in such environment.
17. As there is lack of correct equipment and very few workers due to downsizing the
management eventually won’t meet it’s sales target.
18. While the management focuses on sales target solely there is a lack of strong
safety leadership from management.
19. Frequently or poorly communicated changes by the management result to
uncertainty.

Task 8: Health and safety management roles and responsibilities

Question 8
Effectiveness of roles and responsibilities in relation to heal and safety management in
the car showroom are as follows:
1. Roles and responsibilities of the managing director (MD) is to report to the regional
national and international boards and assign the responsibility to the Head of
sales for meeting sales target.
2. The sale supervisor having the knowledge of the use of fire extinguisher sees the
comical side and puts the fire extinguisher back and performs his responsibility.
3. The senior sales person being cautious than others highlights that petrol vehicles
are in the showroom and puts emphasises the compliance obligations to learn
inform check and improve through such drills.
4. Due to him being unavailable in the showroom the responsibilities of any health and
safety were assigned to the head of sales and the sales team were also
delegated the responsibility of daily running of show room by managing
directors(MD)
5. The implications of accidents at work are informed by the senior sales person to the
apprentice who is then taken aside by the senior sales person on ground of
suspicion
6. Its the duty of senior sales person to raise concern with top management about the
fire evacuation testing safety issue with the Md in the past.
7. The Md attends his duty at various off site exhibitions, international and national
conferences and frequent online meetings.
8. The apprentice performs his duty of locating the car which he was instructed by
sales supervisor.
9. Health and safety conditions are observed by senior sales person in the showroom
10. The senior sales person is suspicious of the apprentice and confronts him, he
then takes the apprentice aside and informs him about the implications of
accidents at work.
