AFFIDAVIT OF WITNESS

I, VICTOR DELA CERNA, of legal age, civil status, resident of Panghagban,

Buenavista, Bohol after having sworn in accordance with law, do hereby depose and
state THAT:

01. I was present and personally saw that accused, Diosdado Torregosa y
Taghoy, committed the crime of Highway Robbery with Intimidation Against Persons
against the victim Tirso Cruz;

02. I am fully aware of the events that transpired on August 22, 2006,
particularly at Barangay Panghagban.

03. That on the aforementioned date and time, I witnessed the robbery
incident involving a delivery track owned by Pepsi Cola Bottling Company, driven by
the salesman Tirso Cruz.

04. That I observed two armed masked individuals flagging down the said
delivery track, subsequently declaring a hold-up and robbing the
salesman.

05. That despite the ordeal, the victims, including the salesman and his
companions, remained unharmed.

06. That I cooperated with the authorities, specifically the Buenavista, Police,
Station, during the hot pursuit operation led by COP P/INSP EFIPANIO
ACOGIFO and his team, which resulted in the apprehension of one of the
suspects, Diosdado Torregosa y Taghot, in Barangay Lubang.

07. That I positively identified Diosdao Torregosa Taghoy as one of the

perpetrators of said robbery incident.

08. That I willingly and truthfully provide this affidavit to assist in the legal
proceedings against Diosdado Torregosa y Taghoy and any other
individuals involved in the aforementioned crimes.

I executed this affidavit to attest the truthfulness of the foregoing facts and to
support the filing of Criminal Cases against Diosdo Torregosa y Taghoy for violations of
Highway Robbery with Intimidation Against Persons.

AFFIDAVIT OF INVESTIGATOR ON CASE

I, COP P/INSP EFIPANIO ACOGIDO, investigator of Buenavista Police Station, on

my oath as the Investigator-on-Case (IOC), hereby depose and states that:

1. That being the Chief of Police, I am tasked to accomplished my job in the

enforcement of laws and ordinances particularly in my area of jurisdiction;

2. That on August 22,2006, at approximately 12:00 PM, a robbery incident occurred

at Barangay Panghagban, Benavista, Bohol, involving a delivery truck owned by
Pepsi Cola Bottling Company.

3. Upon receiving the report, I immediately organized a team composed of my PNP

personnel PO3 Tito Troadio, PO2 Rommel Petecio, PO2 Jodel Torregosa, and
PO2 Constantine Polinar in Buenavista Police Station to track down and arrest
the suspect.

4. That during the robbery, the perpetrators forcibly took possession of

approximately 18,000 pesos in cash, which was the collection money from the
sales, and fled the scene on a motorcycle towards the municipality of Danao.

5. That during the pursuit operation, one of the suspects, later identified as Diosdo
Torregosa y Taghoy, was apprehended at Barangay Lubang, Buenavista, Bohol.
The suspect was positively identified by the victims as one of the perpetrators of
the robbery.

6. That further investigation revealed the involvement of Diosdao Torregosa y

Taghot in two other highway robbery incidents in the municipalities of Getafe and
Talibon, based on the positive identification by the victims of those cases.

7. That the cases related to the robbery incidents perpetrated by Diosdao

Torregosa y Taghoy have been filed in court, including the case of the robbery
involving the delivery truck of Pepsi Cola Bottling Company.

8. That I attest to the truthfulness of the foregoing statements and affirm that they
are based on my personal knowledge and investigation conducted by Buenvista
Police Station.

9. That I executed this affidavit to attest the truthfulness of the foregoing fact sand
to support the filing of criminal case against Diosdao Torregosa y Taghoy of
Highway Robbery with Intimidation Against Persons.

AFFIDAVIT OF VICTIM/S

I, TIRSO CRUZ, of legal age, civil status, resident of Panghagban, Buenavista,

Bohol after having sworn in accordance with law, do hereby depose and state the
following:

01. I am the victim of the robbery incident that occurred on August 22, 2006, in
Barangay Panghagban, Buenavista, Bohol. My name is Tirso Cruz, and I was employed
as a salesman for Pepsi Cola Bottling Company at the time of the incident.

02. On the mentioned date and time, while driving the Pepsi Cola delivery truck
bound for Tubigon Municipality, the vehicle was stopped by two armed masked
individuals. The suspects declared a hold-up, brandishing firearms and threatening us
with violence if we did not comply with their demands. They forcibly took approximately
18,000 in cash, which was the collection money from our sales, and fled the scene on a
motorcycle.

03. During the robbery, I observed one of the suspects closely and can positively
identify him as Diosdao Torregosa. I am certain oh his identity based on his physical
features and mannerism during the commission of the crime.

04. The robbery has caused me significant distress and fear for my safety and of my
colleagues. It has also resulted in financial loss for both the company and myself
personally.

05. I urge the authorities to pursue legal actionagainst the perpetrators to ensure the
justice is served and to prevent similar incidents from occurring in the future. Further I
declare that the foregoing statements are true and correct to the best of my knowledge
and belief.

II. BACKGROUND OF THE REPORT:

OOA 221200 August 2006 particularly at Barangay Panghagban,

Buenavista, Bohol, a delivery truck owned by Pepsi Cola Bottling Company driven by the
salesman Tirso Cruz together with his three truck boys were robbed by twoarmed
masked wearing persons. Initial investigation conducted by Buenavista PS disclosed
that said delivery truck while on their way bound to the municipality of Tubigon, were
flogged down by the suspects and at gunpoint, declared hold-up. The suspects were
able to divest from the salesman collection money amounting to more or less 18, 000
pesos in cash and hurriedly fled away on board a motorcycle heading to the municipality
of Danao, Bohol, leaving the victim unhurt.

III. RESULT OF ACTION TAKEN/INVESTIGATION:

In the hot pursuit operation conducted by Buenavista PS headed by the COP

P/INSP EFIPANIO ACOGIDO together with PO3 Tito Troadio, PO2 Rommel
Petecio, PO2 Jodel Torregosa and PO2Constantine Polinar who proceeded
to Barangay Lubang of the same municipality together with the victims,they
spotted one of the suspects who was standing in front of a small store at the
said place. The team immediately picked up the suspect identified as one
DIOSDAO TORREGOSA y TAGHOY, 29 years old single and temporarily
residing at Bgy Lubang, Buenavista, Bohol who was positively identified by
the victims as one of the two suspects who held up them on that day. The
other suspect is still unidentified as the arrested suspect alleged that he did
not know the name of his companion and continuously denied any
participation in the hold-up.

IV. ASSESSMENT/FINDINGS:
 In the course of further investigation conducted, it was found out that
suspect Diosdado Torregosa had also perpetrated two other highway
robberies in the municipalities of Getafe and Talibon. The victims positively
identified him when he was presented to them. Among the robbery hold-up
incidents perpetrated by the suspect were; the robbery hold-up victimizing
Reynaldo Lending collector Ariel Ibaoc that happened on or about 091400
Jun 2006 at Bgy Tanhaligue ,Talibon, Bohol; amdthe robbery hold-up
victimizing Delilah Incon that happened on or about 051745 August 2006 at
Bgy Campao Oriental , Getafe, Bohol. Both cases were already filed in court.

In the incident victimizing the delivery truck of PEPSI Cola Bottling

Company, the case was already filed om August 24,2006 against DIOSDAO
TORREGOSA y TAGHOY, et. al., before the Provincial Prosecution of Bohol
and docketed under I.S. Case No. 06-27241 for the crime of Highway
Robbery with Intimidation Against Persons. This case is now on
preliminary stage.

V. RECOMMENDATIONS:

Confronted with the foregoing development, it is hereby

recommended that the case be considered SOLVED and be set aside pending
disposition of same while in the court process.

1. This is an initial report about a robbery incident happened at Barangay

Panghagban, Buenavista, Bohol. This case was reported to this office at
1:00 p.m., 22 August 2006 by COP P/INSP EFIPANIO ACOGIDO, of
Buenavista Police Station.

2. Investigation revealed that at about 12:00 p.m., 22 August 2006 at

Barangay Panghagban, Buenavista, Bohol, a delivery truck owned by Pepsi
Cola Bottling Company was robbed. The truck, driven by salesman Tirso
Cruz, was flagged down by two armed masked individuals while on route to
Tubigon. The perpetrators, after declaring a hold-up, took approximately
18,000 pesos in cash from the salesman and fled on a motorcycle toward
Danao, Bohol.

3. The suspect was a male, Filipino. No means of identification was found.

None among the curious onlookers could give any information about the
suspect.

2. That on August 22, 2006 at about 12:00 PM, this office received information that
one Tirso Cruz with his three (3) truck boys were robbed by two (2) armed
masked wearing persons. That on their way bound to the municipality of Tubigon,
were flogged by suspects and at gun point and declared hold-up.

3. COP P/INSP EFIPANIO ACOGIDO together with PO3 Tito Troadio, PO2
Rommel Petecio, PO2 Jodel Torregosa and PO2 Constantine Polinar, conducted
deep investigation and find out primary suspect. With that preliminary
investigation, Questioning and Interrogation of the suspect has done. Through
Questioning and Interrogating suspect admit his guilt.

4. The suspect was one Diosdado Torregosa y Taghoy, 29 years old, single, and
temporarily residing at Barangay Lubang, Buenavista, Bohol. The crime
happened due to personal issues and intentions.

5. In this connection, a case for Robbery with Violence Against or Intimidations of

Persons has already been filed on August 24, 2006 against Diosdsdo Torregosa
y Taghoy, et. al., for the crime of Highway Robbery with Intimidation Against
Persons.
