MUTUAL CONSENT DIVORCE PETITION FORMAT

UNDER SECTION 13(1)(B) OF HINDU MARRIAGE ACT 1955

THE MUTUAL DIVORCE PETITION


This Mutual Divorce Agreement is made on this 10.04.2025 by and between:

Party A: PALLAVI CHOWDHURY, residing at J-601, Ajnara Homes 121, Noida, U.P.
Party B: SANTANU DUTTA, residing at Nayantara apartment, plot 8b, Dwarka, Delhi

Collectively referred to as “the Parties.”

Whereas, the Parties were lawfully married on 31.01.2020 in accordance with the applicable
Law, and have since lived together as husband and wife;
Whereas, due to irreconcilable differences, the Parties have mutually agreed to dissolve their
marriage amicably;
Whereas, the Parties now wish to enter into this written Agreement to settle all matters
relating to their marriage, including maintenance, property, custody (if applicable), and other
legal obligations.

Terms and Conditions

1. Mutual Consent
Both Parties agree to dissolve their marriage by mutual consent under the relevant
provisions of the Hindu Marriage Act, 1955 / Special Marriage Act, 1954 or
applicable law.
2. Maintenance / Alimony
o Party A / B agrees to pay a lump sum of ₹ 10 lakh to the other party as full and
final settlement.
o No further claims for maintenance shall be made by either party now or in the
future.
3. Child Custody (if applicable)
o NA
4. Property and Assets
▪ NA
5. No Future Claims
Both Parties declare that they shall not have any claims against each other in the
future with respect to any movable or immovable property, maintenance, or other
legal rights.
6. Withdrawal of Cases (if any)
o NA
7. Agreement Execution and Filing
o This agreement shall be presented before the Family Court at the time of filing
the mutual divorce petition under Section 13B of the Hindu Marriage Act or
applicable provisions.
8. Binding Effect
This Agreement is final and binding on both Parties and has been entered into without
any coercion, force, or undue influence.
