A RESOLUTION CLARIFYING ANNEX "A" OF THE OPEN


ACCESS TRANSMISSION SERVICE (OATS) RULES

WHEREAS, on 13 December 2006. the Energy Regulatory


Commission (ERC) approved the Open Access Transmission Service
Rules (OATS Rules) to govern the services provided by the party that
operates the high voltage backbone Transmission System;

WHEREAS, part of Annex A to the OATS Rules is a pro forma


Service Application denominated "Transmission Service Application
Form'" ,

WHEREAS, the Transmission Service Application Form is an


integral part of the OATS Rules;

WHEREAS, 16th and 36th entries in the Transmission Service


Application Form contain the note: "The single line diagram should
indicate the: approximate distance of the applicant's facilities to the
nearest TransCo tapping point where the applicant intends to
connect'" ,

WHEREAS, this note has been invoked by prospective


Transmission Customers to justify their proposed bus-in connection
to the nearest transmission line;

WHEREAS, on November 26, 2015, the Grid Management


Committee (GMC) presented its recommendations on Grid
Connections;

WHEREAS, the GMC recommended that to ensure reliability of


the grid, access or connection by prospective power generating'
plants to the grid shall be directly through the nearest existing
transmission substation; /

WHEREAS, the ERC concurs with the GMC recommendation;

WHEREAS, the ERC is cognizant of the need to clarify that the


"tapping point" mentioned in the Transmission Service Application
Form template shall refer to the nearest transmission substation of
TransCo, now the National Grid Corporation of the Philippines;

NOW, THEREFORE, pursuant to its mandates under Republic


Act No. 9136, the ERC RESOLVED, as it hereby RESOLVES, to
issue this clarification to all concerned that for power generating
plants, ,the, term "tapping point" mentioned in the Transmission
Se"rvice Application Form template, which is part of Annex A of the
,.I • ..OATS Rules. shall refer to the nearest transmission substation of
. ". TransCo, now the National Grid Corporation of the Philippines.

This Resolution shall take effect immediately following its


p'ublication in a newspaper of general circulation in the Philippines.

Let copies of this Resolution be furnished the University of the


Philippines Law Center-Office of the National Administrative Register
(UPLC-ONAR), the National Grid Corporation of the Philippines, the
Philippine Independent Power Producers association, Inc, (PIPPA)
and all Generation Companies.
